I have the luxury like most to own rental property.  I own an upstairs unit condo.  Last Thursday I got a call from my tenant that the Hot Water Heater broke.  I immediately called my plumber, and he got out there and drained the tank.  However from the 50 gallon tank about 25-30 gallons emptied into my neighbors unit below.  I told the neighbor I would take care of the damage, but my first concern was to stop the leak and get a new hot water heater installed.  She insisted that we have severe mold damage.  I told her not to throw that word around lightly since we really do not know the damages and these issues can today lead to lawsuits. I took down her number and scheduled a water restoriation company to go out and assess the damages.  Then I ran into the owner again on Saturday and her and her mom insisted that they have mold and severe damages.  Since I did remodels in the past and ran into real mold issues in the past, I told her she was over reacting and that we needed to wait for the water restoriation company to come out and assess the damages.  Finally on Tuesday I got the water restoriation company out there and sure enough he felt there was NOT any mold issues.  His company is working on a bid to open up the drywall, get the blowers to dry everything and then redrywall, texture and paint.  The homeowner again insisted that there was mold.  I told her as follows:  " I will pay for the mold test which costs $500.00 but if mold is not found then she will pay for it.  How quickly she changed her tune and said to have the company just fix it without the mold test.

Sorry to hear that this happened to you. Land-lording is not easy and this is just a prime example of a Landlord's head ache.

You did everything right. Not every landlord is as responsive as you are! It is unbelievable how your down stairs neighbors were trying to milk the cow. They obviously don't know that Mold does not grow "over night"....
