Changes in TN Sales Contracts, good or bad?

This is to all agents, not just Tennessee.  Each year is seems like someone goes and updates our TAR contracts.  I agree change can be good.  BUT...that old saying you can't teach old dogs new tricks, well it applies to some agents as well. 

In 2007 TAR (TN Association of Realtors) changed our sales contract.  The biggest change was how counter offers would be handled.   In the past, one could strike out what was to be changed and have their clients sign off on it at that point on the contract and still be able to accept the contact without extra work.  Now if you strike through and change the original contract there is not a place to accept the contract if it were countered.  The agent that is countering the offer must fill out a separate form and spell out the changes.  It is more work but I really think it makes things more clear.  I have caught many agents reverting back to the old way and I politely ask that they write it up on a counter form.  Once I point out why, they don't mind and say that they have not noticed the change in the contract.

We use counter offer forms in my area and they seem to give clarity to the contract.  Of course not everyone would agree, but they work out well for me.

Small changes we still just mark through (and I'm here in TN), but if it gets to be too much, most agents that I work with agree to do it verbally until we come to an agreement and then have everybody sign a "clean contract." 

Personally, I like the TAR forms on-line.  It makes it so much easier and neater.  :o)
