Think you'll never be sued because you do everything by the book? These frivolous and baseless lawsuits could happen to you.

1Rain, Rain Go Away:     It hadn't rained in a long time, but after the closing on a home, there was a heavy rain, and the new Owners' back yard flooded. They sued the Sellers and the Sales Associate, says Joe Boyd, a board-certified real estate attorney with Boyd, Lindsey & Sliger PA in Tallahassee. "At the trial, the judge went out to look at the property and ruled in favor of the sellers," says Boyd. "The judge noted that the yard was the lowest point in the neighborhood, and said, ‘Everybody knows water runs downhill; where did you think the water would go?' But by that Time, everybody had spent at least $20,000 in defending themselves."1

 Flight Check:    An agent sold a property located on [the] west side of Palm Beach International Airport in a community where the property lined up to the back of a runway," says Gary Nagle, a Juno  Beach attorney. "But, when the buyers purchased the property, the runway was undergoing expansion, so it wasn't obvious for maybe a year that they bought in a flight path for the airport." The buyers sued because of the noise, but right after they admitted under oath that they'd grown up in West Palm Beach and knew exactly where the airport was, the lawsuit was dismissed, says Nagle.1

 Bugged:    Buyers brought suit against their agent and broker because after closing, they found their house was filled with termites, says David R. Carter, an attorney in Spring Hill and New Port Richey. "The sellers [had] disclosed that there'd been termites at one time and that the property had been treated, and the agent gave the buyers that report. Then the house was inspected by a home inspector and a termite inspector, and termites weren't found," he says. Kathy:  I heard that the chance of being sued when you are a realtor are about 1 in 100, especially if you primarily work with buyers.
