Regarding deposits in CA, if I am representing the seller I want 3% deposit as most buyers will initial the liquidated damages clause wihich allows the seller to possibly keep the deposit if the seller backs out and has removed all contingencies. Probably the seller will have to go to court to get the deposit as the buyer most likely will not release his deposit to the seller.
In representing a buyer, I usually will advise to put up under $7500 and then increase deposit to 3% upon removal of all contingencies. Small claims court allows a judgement up to $7500.
