When it is being counted by the Chesapeake Preservation Act.  Most cities around here count a pool as a hard surface, the same as a driveway or shed.  Virginia Beach does not count pools as a hard surface.  That affects how a homeowner landscapes and how the city pays for runoff.  The city says the pools retain the water and don't let run off before being treated.  The Chesapeake Bay Local Assistance Department sees it differently.  The city of Virginia Beach is in trouble because of this and could lead to a lawsuit.  City officials and regulators are trying to work out a compromise.
