Deal Killer or Pawn?

In the last few weeks I have had several potential clients call me to ask about a home inspection. The call goes something like this...

"Yes, we've put in a contract for a home and are having second thoughts. The house may be too (big, expensive, far away from work/family, etc). We understand that if we get a home inspection, we can get out of the contract. Is that correct?"

Wow, talk about a lose/lose proposition for a home inspector.

What would you say?

Any decent buyers agent will put in several opt-out options.  Inspection is only one of them.

But, if these people are looking for a way out before they even have the inspection?  They aren't to motivated.

I would say to just do your job, there actually has to be something wrong to use the inspection as an escape.

Do an honest job. If they are truly not wanting the house that will be upto them to find a way out.

I agree. All you can do is your job. Something bad would have to come from the inspection for them to get out that way. They don't appear too motivated if they've come up with excuses like that. I'm sure they'll find a way to back out if that's what they really want to do. Are they young or 1st time buyers?

In Ohio no one has to be certified to inspect homes.

And I am refering to the CBR contract used here. Basically you can get out of the contract if you as the buyer does not like the opinion of any inspector that you use. Could be your brother.

This is not legal advise.

IMHO just say "we changed our minds". Again in Ohio specific performance is hard to win.

A buyer can change his/her mind at any point during the contingency period.  Their decision is not dependent upon a home inspection.  I would inform a client who calls me with such a question to refer to their agent, decide whether they would like to go ahead, then call me back.  I would also inform them that in an honest inspection, the inspector finds what he finds---I always say, the home will tell its own story to those who know how to read.

Depending on the contingency clause, you may be their only "out".  That's why I ask to have a copy of the contract as a part of the written record - in my possesion.  It's protection.  I also take notes about the conversation and also have great communication with the agent involved - so they have a heads up too.

I've done a number of them with the understanding that the only way for them to get out of the contract is through a home inspection. I've been asked to do this by both buyers and agents. I see absolutely no problem I do my normal home inspection and they get the report. Works every time.

One time an agent called me as I was just starting and she said I needed to find at least a thousand dollars worth of repairs. I said done, I've got at least that and I just got out of my car. "Good job" was her reply. I collected my fee but never did an inspection on the house her client was buying for real, I wonder why. 

 Why is it a a lose/lose proposition for a home inspector?

I let the HOUSE tell me about it's self. What is there is there,, no more no less. I won't compromise myself in any  situation. If they wish to get out of the deal I figure that is up to them,, not me.

I will not do an inspection if the only reason that I am there is to 'kill' the deal.

That said I will be a 'hired gun' if I think that one of the parties was taken advantage of or was so poorly represented that they need an expert opinion.
