I just love final walk throughs! Why is it that Buyers and their Realtors sometimes try to spoil the elated feeling I get, knowing that we finally made it to day of closing?

I get the call this morning, telling me they did the walk through and everything is OK, except for the hole in the living room wall. What? A hole? How can that be? I was just in the house last week and it was fine. No holes! I don't want to hear about holes two hours before closing. I mean the house is vacant. No one has been in the house but the appraiser. Then they spring the big one on me. "What's the Seller going to do about it?"

Personally, I think that's a pretty good question. "What's the Seller going to do about it?" Well, my answer is "I don't know". I am still trying to digest the fact that there is hole in the living room wall. Well I got lucky, the other Realtor had a call beeping in on him and decided to take it and call me back.

So, I get myself out of bed (not sleeping mind you, but diligently "working" on reading all the ActiveRain posts from last night), anyway, I get myself out of bed, hop in my SUV and burn $10.00 worth of gas to go check out the hole in the living room wall. Now I'm a pretty observant guy and would probably notice a hole in the living room wall, but I don't. No hole. Well, maybe they meant the family room. So I go look and again, no hole. Wait a minute, what's that? Let me see, if I get down on my knees and squint just right I can see a tiny indentation in the wall about the size of my pinky fingernail. This my friends must be the culprit. The all elusive hole!

I call the Realtor back and tell him I have been at the house to look at the "hole" and asked him if he had actually seen it, or did he just allow the Buyers to go over by themselves to do the walk through? Do I need to even tell you his response? Of course he hadn't seen it! It was too far for him drive to so he just gave the buyers the code so they could do their own walk through! The Buyers told him there was a hole in the wall, and asked, "What was the Seller going to do about it". Anyway, I remained calm and politely told him to show the Buyers the definition of "hole" in the dictionary and that we would give them compensation of 50 cents. After all that, the Realtor told me to not worry about it, that he would take care of the Buyers.

I tell you, you got to love this business. The things people try to get away with. And the Realtor..........well that's good material for another post.

The Moral is: Never, ever, take the other party's, to a transaction, word on anything. Check, double check and check again. Look out for your own customer's or client's interest or that "hole" may be in your wallet.

By the way...........Does that 50 cents have to be on the HUD?

It's sad.  It's just sad.  What did the buyers think, that the listing agent was as unethical, lazy and would just take their word for the hole and pony up some cash???

I agree, the buyer's agent most certainly should have accompanied the buyers on their walk through.  On one of my listings I had a buyer's agent tell me that the house was so cute and my seller so nice that she didn't think a final walk thru was necessary!!!  I made her client sign an addendum at the closing table that he had waived the final walk-thru...unbelievable!!!

Hasn't that realtor made several violations?  I bet he and the buyers were banking on you not getting in your car to earn your commission and protect your client's assets.  Congratulations on being a professional.

There should be an addendum, or clause in every contract for re-sale properties; "Any repair that would cost in excess of $XX is the buyers sole responsibility"

Oh my word... that other broker has left me speechless... I can't even imagine letting my buyers go anywhere without me if we were about to close. I wouldn't even want them to drive, I'd hand deliver them personally to that closing. What was that person thinking?

I'd dock his commission by $10 if you could, to at least pay for your gas. (Send a message...)  Heck, the guy gave the lockbox code to his clients.  Big no no.  BIG.

BB - This one made me laugh.  I sure wouldn't want a buyer to do a "walk-through" alone either.  I feel your pain, and agree with your "moral" to the story.  But, hey since you are a FL dude, I had to throw this in.....gee do ya think FREC needs a new definition of a "Hole" or "Dent"???  OK, I know.....shut up Chris!

...and someone should "take care" of the buyer's agent.  Allowing clients into the house, unaccompanied, is unacceptable.  I'm not even going to list all the "What if's" that could have happened, that would have resulted in large law suits against all agents & agencies involved.

...regardless of your relationship with him... (friend, colleague, lifelong buddy)... I hope you read him the riot act.

Yup, it has to be shown unless the buyer and seller agree outside of closing.

Lol, this is hilarious, a "hole in the wall". Well by contrast hole do have different meanings. Was it a puncture, break, tear, list goes one. I thought you handled it well. How embarassing that must have been for the buyers agent. Again, this was pretty funny but in truth does happen.

If I had a dollar for everytime the other Realtor didn't show up at the walk through for a house I had listed, I would be making great extra money!!  I always think the same thing... LAZY and poor service.  funny post of the "hole" thanks for sharing

Broker Bryant - Wow!  That is so funny!  I know it not funny at that time but to understand it was a little tiny hole.  I don't let buyer go by themself to do a walk through, I go with them no matter what.  Wow!  It happen here too with agent not going with the buyer for a walk through.  :)

Oh I have stories. Mine are usually the other way - "Are there any holes in the walls?" "No." As most people know a home must be "move in condition" or "liveable" to get a conventional mortgage. A while back I posted some photos of a "liveable" home.

Bryant, I am abit confused is it me I am the 37th one to comment on your post no one noticed You wer not at the Final Walk thru either. I am a firm believer I am present at the Termite inspection, physical inspection,  appraisal and ofcourse at the Final Walk thru call me oldfashioned, but I consider it my duty and obligation to the Seller.

In our area it is against the rules of our MLS to give any lockbox code or Supra key to anyone. 

Not sure why the buyers agent would think that a walk through without him was smart, isn't that what he is supposed to do to earn his commission?

In our area the listing agent is not generally at the walk through if there is one.

Now that is a "hole'' lot of unprofessionalism on the buyer's agent's part.  Hope this showed him/her to do his/her job right next time!  And they say all agents are the same!?!?!

I know what you mean! What bothers me most in this situation is the combative stance from the other agent at the get go. The opposite of this is a whining, excuse filled approach that is often the case. I remain calm the first time or two when presented with this style of communication but if it continues, I am fairly blunt and make it a point to speak up and ask the person to relax and just give me the facts. It IS an interesting business!

Endre, Actually you are the only one to mention that out of over 50 comments at this point. Very good observation and great question. This particular property was vacated about a week or so earlier by the Seller. It was only 2 years old and was in excellent condition with no repair issues. I had actually been in the property the day after the sellers moved out to make sure they had left it cleaned and also to secure the property. Once I've done this my next trip into the property is on the way to closing to do my final walk through, remove the sign and lock box. I rarely attend the buyers final walk through unless I feel it's going to be an issue OR I am on the buyer's side of the transaction.

Great comments everyone!!! I did write a follow up to this post the last time I posted it. Maybe I'll repost hat one later today. It addresses the REALTOR(R) and what to do about them giving out my lock box code. My way of handling that was contrary to most.

BB - Endre's comment made me think.  I wonder how many listing agents attend the final walk through while the buyer's agent is there with their client?  It just isn't done that way in my local market, but it makes perfect sense to do so to head off any last minute issues at the closing table.  So why don't we do this as part of our practice?

Interesting the buyers considered that a hole in the wall.  I cannot believe the agent had them do their own walk through and gave them the code to the house; that is wrong in so many ways.

I vote that $9.50 goes on the HUD where the agent is reimbursing you for the gas it cost you to have to defend your listing/sellers when he gave them the code and didn't do HIS job.  Can't wait for the follow up post on him not doing his job.

Ah, Bryant, some days I just shake my head in amazement at the nonsense buyers and sellers try to pull.  I worked for years in title before I split from it and went my way as an EA, but man...  Some of the discussions at the table were nuts!!

IE:

Seller: Of course the septic field has been surveyed!

Buyer: We'd like the certification, please.

S: Certification?  Um.... *starts digging through paperwork*

B: If the site had been surveyed, you should have a certificate, fairly recently, in fact.

S: Hold...on...just one mom--AHHA! *pulls out a crumpled piece of paper and hands it over*

B: *reading aloud* "I looked at your spot.  Looks good."  *looks up* You had this done by a surveyor?

S: Yeah! My brother...he surveys real good!  Great eye.

B: *shoves back from the table and pushes the HUD away* I'm not signing.
