According to the Colorado Definitions of Broker Relationships (25-5-04 DEFINITIONS OF WORKING RELATIONSHIPS, Colorado Real Estate Commission):

"Broker shall exercise reasonable skill and care for the Buyer, including but not limited to the following:
1. Performing the terms of any written or oral agreement with Buyer;
2. Presenting all offers to and from Buyer in a timely manner regardless of weather Buyer is already a party to a contract to Purchase a Property;
3. Disclosing to Buyer adverse material facts actually known by Broker;
4. Advising Buyer regarding the transaction and to obtain expert advice as to material matters about which Broker knows but the specifics of which are beyond the expertise of Broker;
5. Accounting in a timely manner for all money and property received; and
6. Keeping Buyer fully informed regarding the transaction.
Broker shall not disclose the following information without the informed consent of the Buyer:
1. That Buyer is willing to pay more than the purchase price offered for the property;
2. What Buyer's motivating factors are;
3. That Buyer will agree to financing terms other than those offered;
4. Any material information about Buyer unless disclosure is required by law or failure to disclose such information would constitute fraud or dishonest dealings; or
5. Any facts or suspicions regarding circumstances that could psychologically impact or stigmatize the Property.

Great post.  I just had a showing at one of our listings today with buyers that I was meeting for the first time.  They actually came out of a home just down the street from our listing after seeing it with another agent.  Needless to say, I was working the benefits of having me help them in their search versus the other agent.

Why aren't buyer's agents forth right about the "exclusivety" of BC60-04-05?  I'm stuck with a buyer's agent I don't like.  The wording of the contracts makes it sound as if it's exclusive only to properties that agent shows you.  I want to switch but apparently I can't, I would have NEVER agreed to sign had I known it would be exclusive to him for 6 months.  Why don't you explain that on your page?

JARED - I can only speak for Colorado, so if you are NOT in Colorado, my answer may not apply. (This is also why I did not address this in this post, as buyer agency laws vary from state to state).

First, if you signed something you should have had it reviewed by an attorney if you were unclear about any of it. A buyer agent SHOULD explain it to you, but they cannot make you understand it.

In our state you can fire your agent if you do not like them. However, each office determines HOW you need to fire them. Some require it in writing, some do not.

However, in most cases, you cannot fire an agent once you are under contract to purchase a home.
