| | Letter From the President Hello to all. Hopefully spring is just around the corner. The National convention was another fantastic place to be in February with temps in the 70's. The State hospitality suite was very active seeing many other members from around the state. The greatest thing this February was our Bowl-A-Thon. WOW! What a good time for a good cause. Thanks to Bryce and the whole committee for a great success. March 7 is a big night at the county plan commission. I hear that they may be voting on the new Unified Development Ordinance. This will affect not only new developments, but also all home owners in the county. Finally the Home & Garden Show was a fantastic show and all the vendors that I talked to were very happy with the quality and traffic of the show. Thanks to Dave, the committee, and the office for all the great work. All our events take everyone working together to make them a success. Thanks to all. Tim Chesna President

Legal Landscape Seeking Relief From A Zoning Decision? By Lee I. Lane Hoeppner Wagner & Evans LLP In a recent decision, the Indiana Court of Appeals reversed the decision of the Allen County Planning Commission ("Commission"), and instructed the Commission to approve the applicant's development plan. In reviewing an agency decision, courts will only provide relief if the agency decision is: (1) arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law; (2) contrary to constitutional right, power, privilege, or immunity; (3) in excess of statutory jurisdiction, authority, or limitations, or short of statutory right; (4) without observance of procedure required by law; or (5) unsupported by substantial evidence. Jeff and Tammy Rice (the "Rices") are homeowners who purchased property adjacent to a subdivision. The 3.6 acre parcel was sold to them by the developer who specifically excluded the property from the subdivision during the platting process. The property was located in a district that required a development plan ("Plan") in order to build on the property, but the Rices applied for, and received, a waiver of the Plan requirements. At the same time, the Rices applied for an improvement location permit to build their home and garage on the property. A few months after the permit was issued, the Rices were finalizing plans to build their home when an issue arose regarding the county's construction of a bridge that might deny the Rices access to their driveway. The Rices spoke with the planning and development staff who suggested that they build an apartment in their garage until the bridge issue was worked out and they could reapply for a permit a year later. The Rices agreed and began construction of their garage. However, before the garage apartment was complete, the Rices were notified that the previously issued waiver was revoked and they now had to submit a Plan. At the public hearing on the Plan, a number of the adjacent subdivision's residents opposed the construction because: (1) their developer had allegedly promised them that the Rices' property would remain undeveloped common area; (2) they had suspicions that the Rices were using the garage for commercial purposes because they had observed trucks entering and exiting the garage and a hot tub being stored in the garage; and (3) a subdivision resident presented an appraisal of his property that allegedly revealed a reduction in his property value, presumably as a result of the Rices' garage. In response, the Rices emphasized that: (1) any promises made to the subdivision residents by the developer are irrelevant, because the Rices, not the developer, owned the property at the time they submitted the Plan; (2) the trucks entering and exiting the garage were involved in the construction and interior work on the structure; and (3) the appraisal actually shows an increase, not a decrease, in the particular resident's residence. The Commission approved the Plan with respect to the Rices' home, but imposed a number of conditions, including the condition that the Rices execute a written commitment containing the provisions and restrictions of the subdivision covenants. On appeal, the trial court supported the Commission's decision, but the Indiana Court of Appeals determined that there was no substantial evidence supporting the Commission's decision. The Court reasoned that the administrative act was without consideration and in disregard of the facts and circumstances of the case. Additionally, the evidence relied on must be more than speculation and conjecture.

Meet Elaina Hello fellow members! My name is Elaina Hoskins and I'm the new receptionist for the Porter County Builders Association. I am twenty years old, turning twenty-one in July, and have a very patient, understanding and friendly attitude. I look at life as being a treasure. Living it to the fullest; to never settle for less than what you want; to never take a single second for granted. I enjoy reading, writing and the computer in general. I'm a hard worker, dedicated at what I do and have a positive outlook on life. I also own and run two websites, as well as design graphics on my spare time for a hobby, along with writing. I look forward to meeting each and every one of you and developing a relationship that is built on trust, loyalty and respect.

| From the Executive Officer I would like to express my gratitude to those of you who sent flowers and cards and came to the funeral home when my mother passed away. Her death was unexpected and has been a tremendous loss to my family and many of those who knew her. She was a soft spoken, loving woman who was full of spunk and lived life to the fullest. Family meant everything to her and we were blessed to have her as our mother. She and my father were married 60 years so you can imagine the great void it left in his life. My brothers, my sister and I are there for him and we pray everyday that he finds the strength to continue without her. Nothing in life prepares us to lose those we love and so it begins a journey of healing and memories never forgotten.
