Mortgage Fraud- Update to Play By The Rules!

Real Estate Agent with The Gasset Group & Get It Done For Me Virtual Services 13253167-SA00

Mortgage fraud is really being cracked down on here in Florida. The FBI has been investigating and if you have any information about fraud rings you need to contact the FBI.

Mortgage fraud hurts everyone, not just the lenders. It affects you and it effects me. And one day you will get caught because that is just the way it is so do not participate in Mortgage fraud. Don't play with fire- you will get burned.

I wrote an article back in November 2007 about Johnson Cuffy and his ring of thieves. Johnson Cuffy was also a mortgage broker and owned a mortgage company. I am very careful NOT to name names in my blog unless I can really back it up. Well, I had received my information about Cuffy from the Palm Beach Post and the Sun Sentinal and also blogs online. I was careful to only report the facts in the case.

Johnson Cuffy

Well, a couple of days after I wrote the post Johnson Cuffy called me and threatened to sue me for writing about his case. I told him everything I wrote was public record and that I only reported the facts. He told me that he was sueing the FBI, the Palm Beach Post, The Sun Sentenal and the Sheriff and promised me he was innocent. He said I was ruining his business by telling over 60,000 ( at that time) real estate agents on Active Rain about his arrest and case.

So I told him that if he was innocent I want to hear his story. That if they are wrong I want to know about it because I believe in fair justice and being innocent until proven guilty so I would give him the benefit of the doubt. I welcomed him to discuss the case with me and I would tell his side of the story to Active Rain members. We made an appointment but he never showed up for his interview. Hmmmm. Strike one.

Then I got these comments on my post about him from one of the tenants, Susan Hair, who leased a house from him. He never paid his mortgage payment and yet she was paying her rent. Then the knock on the door, and the sheriff was there to send her on her way. She is one of his victims and is very angry. You can read her comments in the post  I first wrote.  She emailed me that he would be on TV last night but I don't watch the news and did not get her email until after it was over. Then today, Nestor brought me the article in the Palm Beach Post that Johnston Coffy has been convicted of Mortgage fraud.

He pled guilty to mortgage fraud and is serving 2 years probation. He was involved with over 13 homes in Palm Beach county and stole more than 1 million dollars from lenders according to Bill McCullum, Florida Attorney General. He labeled Johnson Cuffy as the ringleader.

According to investigators the ring would apply for mortgages and using straw buyers. Then these straw buyers would apply for HELOCs, Home Equity Lines of Credit as soon as the loans closed. The straw buyers kept some of the money and funnelled the rest to Johnson Cuffy through fake businesses.

The victims were Wachovia bank, Bank of America and GMAC mortgage. They would also inflate the price of the house and have the seller give money back at closing. He was also arrested back in 2001 for federal mail fraud.

Well, he just got arrested again Tuesday with a big round of warrants that went out. This happened after Susan Hair kept complaining that he was not paying the mortgage for the house she was renting. After she reported him to the news, he threatened her. This time he was arrested for stealing an identity, taking out a loan and writing checks on that stolen identity.

This is not his last run in with the law. Now he is behind bars. If you or anyone you know has been one of his victims come forward now. The law is asking you to come forward. They are sure this is not the only victim. The charges are just starting against him.

So now you have the rest of the story!

I would like to see a database that we can report fraud behavior to when we encounter it.

There is a database on loan officers, why not the people who commit the frauds most often, the buyers!!!

I'm proud of your courage, Katerina.  Good job reporting this beast.  How many others are there who have not been caught yet...

Christopher and Stephanie- I think that they should have to go and clean all the foreclosures, mow the lawns, pull the weeds, paint the houses! Jail is too easy and is not the answer for these types of crimes. They took away, the stole so the restitution needs to be equal to their crime.

Bill- I felt that I was reporting the truth and thus I was not afraid. I doubt he will sue me from prison, or if he does, he will lose. I rarely mention names but this instance I had to because I want the people he hurt to know he is in jail and now they can talk.

Tom- Yes, you are right, the buyers were real ring leaders. Cuffy was a mortgage broker. And a woman just called me to tell me her son's identity was stolen by his loan officer in Arizona who used his credit and identity to buy 6 milllion dollars worth of houses here in Florida!

Karen- Thank you, Oh, I have a tough skin and when there is injustice I speak up. This guy just got put away for a long time, especially since he did not learn his lesson when he was on probation!

What a great article.  You did a great reporting job.  How is the market in the high end in your area doing?

Katerina, thanks for the fair reporting. I feel sorry for the tenant-victims. AR is yet another portal for us to share and alert fellow members of such illegal activities.

Enjoyed the update Katerina, but please be careful.  People like him are dangerous, and I'm not the alarmist type.

Susan- I agree, if you or I stole 1 million we would be in prison. That was not his first conviction either. I was surprised he still had a mortgage license after the was already in trouble for federal mail fraud!

June- The high end market is moving, not as fast as it was before the bust, but we are having a lot of showings on the luxury home listings we have and offers coming in. We are gearing up for season, the winter is coming which brings all our equestrian people from the north to here. Our listings will sell during the season. November to April.

Sherry- It is also a portal to let our consumers and people from around the world who follow our blog to know what is going on. I meet people in the community all the time who tell me that they have found my blog while looking up something. Then they follow! What a great place AR is!

Susie- I had a good talk with him after he started yelling at me and threatening to sue me. He never threatened me physically. Most of the time those who commit non violent fraud crimes are not prone to violent behavior. I will be careful. I am sure that he is going to have to at least serve out the 2 years of probation in jail because he violated his probation through identity theft.

Two years probation definately was not enough for someone like that whose actions were ruining people's lives.  I hope they put him away for a long while this time.

Katerina-  Thank you for the update.  It is a shame what some people will do to try and make an easy buck.  Reminds me of that story on the news last night about the sheriff in Chicago who has refused to evict renters who have been paying their rent and their landlord not paying the mortgage.

Katerina,

That is some story.  I wonder with these types of frauds, do they tie in to all these commercials you see on late night t.v. for house flipping programs without any financial investment needed?
