Here is the eighth installment of a mini-series about the new California laws for 2009 affecting Realtors® with licenses in California.Ca law

This new law states that a Tenant victimized by domestic violence can terminate tenancy.  Beginning on September 27, 2008, a tenant can terminate a tenancy upon giving a 30-day written notice to terminate, if the notice also informs the landlord that the tenant or a household member has been a victim of domestic violence, Domestic Violence Bandaidsexual assault, or stalking as defined. The tenant must attach to the notice a copy of a temporary restraining order, emergency protective order, or police report issued within the last 60 days. The tenant is also entitled to a proration of the last month's rent if, within those last 30 days, the tenant vacates and the landlord re-rents the premises to a new tenant. This law will sunset on January 1, 2012. Assembly Bill 2052.  An important law and hopefully will be renewed or even improved on when it expires.

Susan,

I think I responded to your earlier blog about having to use your Real Estate License Number on all documents.  In New York we are a bit behind the time, but I see what ever you institute in CA as happening here within the next couple of years.

I agree with this lastest post.  Once victimized a person should be allowed to leave the residence where they lived at the time of the assault, crime, etc.  It is a shame that this psychologically is not a good approach for the victim, after all they were the VICTIM to the crime and they shouldn't have to change their lifestyle to feel safe.  They did nothing wrong and changing their lifestyle (like moving) solidifies the victimization and the guilt that they did something to deserve the assault. The perpetrator shoudl be penalized and removed etc.  But, I realize that they just keep coming back because they are the emotionally disturbed type and do not think that they did anything wrong.  In fact they are the victims in their distorted minds.

Don't get me started on this one.  I just like the way CA thinks and I will be trying to impose these pieces of legislation here in NY as soon as I can get a legislator to sponsor such bills.  Can you e-mail me the actual bills involved.  I'd appreciate it.....

Thank you for your response and interest in these important bills, I will send you a link and at the end of each one is the Assembly Bill number.  I agree.. the victim is victimized again when they are forced to move from their homes for their own protection.  At least now they can get out of their leases.
