Here is the full text of Ammendment #2 on Florida Ballots:

"Ballot Title:

FLORIDA MARRIAGE PROTECTION AMENDMENT

Ballot Summary:

This amendment protects marriage as the legal union of only one man and one woman as husband and wife and provides that no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized.

Financial Impact Statement:

The direct financial impact this amendment will have on state and local government revenues and expenditures cannot be determined, but is expected to be minor.

ARTICLE I, NEW SECTION

DECLARATION OF RIGHTS

 

Inasmuch as marriage is the legal union of only one man and one woman as husband and wife, no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized." - taken from Flaglerelections.com.

Florida has never been a particularly open-minded or, as my friends on the other side of the fence would say, liberal State when it comes to most things, but I have a fundamental issue with Voting for or against something that will have no impact on my life, yet will have the capacity to injure someone else's. 

The fact that we call these Ammendments "Marriage Protection" as opposed to "Denial of Rights to Gays" ought to tell us something in and of itself. 

I will have been married for nine years, come January.  If my relationship with my husband was a crappy one for either or both of us, we'd go our separate ways, and no Legislature could save our marriage or make it last any longer.  If, on the other hand, we are fine, we'll gladly spend the rest of our lives together.  The State has absolutely no impact on the success or failure of my marriage.  However, the benefits in taxation, hospital visitation, property ownership and inheritance, to name a few, are certainly there for the hubby and I. 

Why would the people in this State, or any other for that matter, want to deny those same benefits to same sex couples is simply beyond me.  Chances are, this ammendment will pass, after all, it sounds so fabulously good - Marriage Protection.  The overt implication that the State can protect a sacred institution is in and of itself bizarrely unconstitutional sounding, but it's also blatantly false.  Worse still, in my opinion, it is worded deceptively, at best. 

The reality of the matter is they are not asking us to Protect Marriage. They are asking us to deny benefits and rights enjoyed by heterosexual couples to same sex couples. It is really that simple, and that black and white.  I simply wish they had worded it as such, so that at least the people voting yes on it would know exactly what they were voting for.  When our Constitution depends on the 75-word descriptor to explain the meaning of what we are voting for or against, I would simply prefer it if those words were plainly stated truths

Meanwhile, the optimist in me is hoping that maybe Florida is changing for the better, and maybe the people in this State will decide that it's non of their business what others do in their bedrooms.  Our rights as people shouldn't depend on the Good Book, - not in this country.  I am hoping Florida Votes NO on 2.

Dick - so if you were in Florida, how would you vote on this ammendment, given those options?

Kristin - I believe the organizations that push for certain ammendments are the ones who determine the verbiage, and in that, the sentiment reflected is always that of the petitioner.  It would be so much more fair and just if the proposed ammendments were submitted to a 3rd party and were worded with educating the voter in mind, versus the desired outcome.:-) Thank you for your well reasoned response.

Inna, I already voted NO on this amendment which BTW was put on the ballot by our republican legislature.  The loophole in this amendment, from what I've read, would also pertain to "co-habitating" hetero couples, denying them the same rights as married hetero couples.

Terry - thank you for bring up who put this ammendment on the ballot. I had no idea, for some reason, that it would also affect non-married co-habiting couples.... Something to think about, that's for sure.

Inna, at the risk of disrupting the space/time continuum, I agree with you. (just this once)

To me, the word marriage is a term of art.  It means the union of one man and one woman and I am not prepared to change the plain meaning of the word to satisfy anybody.  The significance of marriage is for the culture and the churches to determine and I would prefer that government not get involved there.  But we have statutes to reserve marriage for the participants as defined.

But there is more than that in the amendment.  I recognize no legitimate public purpose in depriving same sex couples - call it a civil union or domestic partnership - from enjoying the same legal rights as a married couple.  Such action would be discriminatory and wrong, in my opinion. The language in the amendment that seeks to punish or exclude any other legal union which is treated as a marriage for purposes of legal status and rights or the substantial equivalent thereof is hateful and discriminatory, in my view.

I turned around on this one a few years back when a Tampa Police officer was shot and killed in the line of duty in pursuit of a murder suspect.  Her same sex life partner was denied the right to receive any insurance or other benefits that could have been conferred by the Police department to the family of a fallen officer.  I cannot believe that that is an appropriate result - and the laws should conform to what is right.

I will vote NO on #2 as a matter of law and fundamental fairness.

Hi Inna,

Of course I would vote....no, yes, no.  Politics, religion, and sexual orientation are private matters to me ....like my vote.  I miss those curtains on the booths.  I was too flippant with the "who cares" response,  I do care that my government can even suggest these amendments, like who are they to be so "right"?

Another goody the republican legislature which we have to suffer through here in FL, put in to place, under the guise of the American Voter Rights program (can't remember the actual name) bush put into place to "make sure every vote counts" (yeah right) was to reduce the number of hours our polling places can be open.  8 hours per weekday, 8 hours total on the weekend.  That means they  open after everyone has gone to work and close before they get off.  Pretty sneaky eh?  Even if you can take a little time from work to vote early, the lines in some places here are 5 hours long.  So, either you take an entire day off to vote, or you are disenfranchised, again!

Terry - here we have a blog post that is carrying broad support. I have already said I don't know who placed it on the ballot and I don't and I don't care either. It should be voted down. NOW you come along with a completely different issue and you wish to blame Republicans AND you are WRONG as usual! Polls in Florida are open 7am to 7pm on November the 4th. They are also open RIGHT now for early voting and have been since October 20th I believe. The hours of operation right now are allowing those who don't work to go and vote therefore reducing the lines on Novermber the 4th. If that doesn't work for you, then you could have sent in a vote by mail application at any time over the last FOUR YEARS. So do me a favor - shut the pie hole on this one.

Terry - here people have been voting since early voting started, and while there are lines, enough locations are open both early and late to where it's pretty hard to miss. For those voting on the 4th, the number of locations will be greatly increased, so everyone who wants to vote is looking at maybe a few hours at the most out of their day, if they choose to wait that long... :-)

Simon - play nice!  I thought Brits didn't use "pie hole" - alsways seemed as American to me as the notorious pie itself-
