In NC, we have the option to work exclusively for a buyer, exclusively for a seller or to work as a dual agent - representing both buyer and seller.

  Personally, I believe that just because we as NC agents have the option to work as a dual agent doesn't mean that's the right decision for everyone. I prefer to work exclusively with a buyer or exclusively with a seller, NOT for both parties.

  I consider loyalty a pretty big deal, and that's exactly what's sacrificed when taking on the role of a dual agent. While working with clients I get to know a lot about them, their families, their goals and fears, confidential information that they wouldn't want the other party to know. I'd much prefer to be firmly on one client's team and be able to work for their best interests, giving advice, support and guidance as their exclusive agent.

  Some agents may certainly feel that dual agency is a good fit for them and that's fine but it just doesn't work for me.

I agree with you 100%. I won't do dual agency as I don't feel it is ethical, even though the state of Texas says its OK. There is no way to fairly represent both sides to the best of your ability. This is why I won't hold my own listings open. I have an arrangement with a couple of other Realtors and we hold each others listings open. This allows us to avoid being stuck in dual agency situation. In these times I say better safe than sorry. good luck & great post!

Hi Betina, Exactly! In theory it "could" work but the reality can be very different. I'd rather be fully committed to one party than try and equally serve both. You have a great idea on open houses!

Dual agency is also an option in my area.     Like you, I prefer to designate who it is I'm working for.    It's better for the realtor, I think, as well as much clearer for the client served.

I agree with you as well.  We are allowed to do it here in Oregon, but it feels awkward.  I often will refer the client on to another broker that I know will do a good job.

While I am not an agent, I really liked this post.  As a consumer, the idea of having the same agent that listed the house representing me as the buyer has always made me a little nervous.  Great post!

Thanks Jeff! It can definitely affect consumers and lead to confusion. Trust is a key component and if I were a consumer I'd want to be able to trust that my agent's looking out for me and no one else...

As a transacton coordinator, I don't care to process closings that is a dual agency. I prefer being loyal to the buyer or the seller and a lot of times, I'm asked questions by both sides because the agent doesn't want to get involved. I also find that the definition is not always clearly given to the buyer and seller. This leaves them confused and sometimes questioning the integrity of the agent.

I've done it four times this year and its worked out beautifully each time.  No glitches!  It actually made the closings go smoothly.  I almost did it a 5th time but the buyers lender recommended they use his "friend" since he felt Dual Agency wasn't the best for them.  Well, that agent didn't show up for the closing, and the buyers hugged me at the closing!

The key:  Reasonable buyers and reasonable sellers.  I'm a very loyal person but I also know how to get to the goal line with both parties.

Hi Carolyn, It's certainly interesting to hear the perspective of a transaction coordinator, I agree about the potential for confusion and think it's disturbing for an agent to "not want to get involved", regardless of which party I represent being involved in the contract to closing process isn't optional for me!

Your note about "reasonable" buyers and sellers is well taken, sometimes "reasonable" isn't always easy to quantify and buyer and seller can many times have different definitions of that word!
