I have a client with a Clearwater Beach oceanfront condo who is interested in selling it in fractional shares, possible to snowbirds who only want to be here in Florida a few months a year.  It's an interesting concept, a condo which would otherwise be $574K, would be split 4 ways to only cost each person $143,500.  We would like to try marketing it this way.

I admittedly have no experience in this area and am looking to hear from others who have done it who can explain the process a bit to me.  If you sell it in 4 shares, 3 months per person, do you have to find 4 people willing to do it before the sale can be completed (which could take awhile) or can you sell one share off at a time and close separately on each individual share before finding the next customer?  How much money in attorneys fees might be involved in structuring something like this?  Any advice?

great idea - I would want to see a reserve fund in case one of the partners gets foreclosed on their share?

Wouldn't that be like a time share? I'd contact a Real Estate attorney.

Cleaver idea though.

I checked with my broker and no, its not the same as a timeshare.  In a timeshare the participants don't know who owns the other parts of the timeshare.  We as Realtors cannot sell timeshares but we can sell fractional shares - but what I am confused about is how to write up contracts for something like that and if they'd all have to close at the same time or if they could close separately.

I know a ton of time share sellers near Disney and they are all Realtors.  I'd double check your info.

And, it does sound like a time share, if they are purchasing the rights to the property for specific time periods of the year.  The fact that they know each other seems irrelevent to me.  But, what do I know?

Liane Ive heard of other realtors trying the same concept- fractional ownership. You can do some online research about "fractional ownership" by googling it.

I think its a like concept like timeshare sales where a buyer would buy weeks of the year of ownership at at time. They would be separate transactions and wouldnt have to close together.
