Using Microsoft Clip Art in your Blog Posts? Better contact your copyright attorney.

 

If you are like me I had been using the Clip Art that came with my Microsoft Office. But because of all the posts and talk lately on Active Rain about copyrights and trademarks I decided to search out what Microsoft had to say on their site about the use of their images.

This is what the site says:

Microsoft products, services, and Web content—including images, text, and software downloads (collectively, "Products and Services")—are owned by Microsoft Corporation and/or by Microsoft vendors, who have given Microsoft permission to use the Products and Services.

Unless Microsoft explicitly gives you permission within the End-User License Agreement (EULA) or License Terms that accompany the Products and Services and/or in the guidelines below, you may not copy, modify, distribute, display, license, or sell any Products and Services or components contained in them.

Now I don’t know about you but I for one do not want to have to consult my copyright attorney because I used an image from Microsoft. So, please take the time to read all the fine print before using ANY image that is not your own!!!!

First of all, if they don't want the clip art used, why make it available?

Second, doesn't the agreement say that you can use the clip art? (Usually in conjunction with a purchase of software)

Kelly - Best thing I've learned is to use Flickr.com, but use the "advanced search" function and only use photos with Creative Commons licensing.  Always attribute the work to the original author and include a link (who doesn't love a link to their work?).

Maria: the agreement says: you may not copy, modify, distribute, display, license, or sell, I'm just posting what the site says. I believe the images are just for your personal use not display on blogs but I'm not a copyright attorney. Keep using them and maybe your copyright attorney can clear this up for us.

Wow! Are you serious? I thought that was why they made free clip art. I shall absolutely discontinue use. I've done it only a time or two. Don't know where those posts are...but I surely shall not do so again.

I, too, thought that clip art was pretty much fair game, but don't use it very often because I don't like the cartoony look.  I'm surely going to refrain now.  Thanks.
