Not sure about the reference to water rights.  The state of Texas owns all flowing water, either above ground or under ground. 

Texas law prohibits the damming of live streams without permits.  The creek on this property is not live.  Only during heavy rains.  If dammed up, it could impound anywhere from 1/2 to 3 acres of surface area.
