Are My Pictures Copyrighted???

I recently had one of my listings expire.  Nothing new these days.  The seller re-listed with another agent.  This agent is a big producer in my area.  She is very aggressive.  One of those that calls you five times before you can call her back.  By the way call her and you are lucky to hear from her by the end of the day.

Back to my blog.  I like most agents wanted to see the new listing, price information etc.  Everything looked good until I saw the pictures.  They were the exact ones I took back in March.  How do you like that?  My broker informed me these are copyrighted and I had not giver her permission to use them.  I really don't mind her having the listing or selling the house, but do your own work.  Stop being so lazy.  Makes one wonder how many times has she done this before.

I have by the way contacted the local MLS.

Our multiple has addressed this issue.  Our primary photo can be used during the term of the listing and thereafter, for any purpose related to the listing and sale of the property. All other photos and virtual tours a member licenses the multiple and its members to use can only be used during the term of the listing. All photos maybe be used by the multiple and its members for "off-market" purposes. So if she was in our system she wouldn't be allowed to use the "other" photos, only the primary photo. I would have her remove them.

Is that the end of the story?  Are you going to contact her, the MLS or anyone and ask that she remove your pictures?

John, I agree, being a newer agent I go and do everything and the reusing of anothers picture is really low.  She's going to make how much money and she can't take her own picture?

They definately cant use your pictures for anything period let alone to use them in your MLS. Thats a double violation for sure.

By the way you describe the other agent, I think the best way to handle this is through the MLS. If it is a violation, let them deliver the bad news. There's no point in making yourself a 'target' of this lazy agent.

John, you know the way i think about things. Beside the obvious reason not to use your photos, why not take a fresh approach to a listing. In all fairness to the seller give them a helping hand in selling their property. Why use something that did not work the first go round.

"Foreclosure" experts out here seem to be the best at not doing their own work. I regularly see the same pictures in the foreclosure listing that I saw in the short sale listing that I saw in the pre-short sale listing. Our MLS has a nice little button that we can click on to report violations.
