You'll want to be careful with "Fee For Service Payment Step." The attorney MUST take the client on their retainer under the attorney/client privilege or this is a violation of the code and the AG's office shut down a large shop and sued for millions making the shopt disgorge all ill gotten proceeds. Many people erroneously think that just working with a law firm circumvents the code...it does not. Almost all borrower should have attorney/client privilege on their submission because they contributed to the lie on the stated income loan and prosecutors and starting to go after some and banks have six years under fraud statutes to pursue people and they've just given them the smoking gun without a privilege.

Thanks for your feedback.  The attorney is taking the client directly in a client-attorney relationship.  I value your opinion.  Loan modifications and the laws surrounding this subject are very new.  I don't want to be the one selected for creating case and precedent. 

Question: I noticed you are an attorney.  How would you go about dealing with the loan modifications?

I have yet found a reputable attorneys office that are successfully completing loan mods as cleints expect. The ones I am seeing done could have been done with the simple steps of putting together the info. in a professional submission (Complete) and play the waiting game. Most lenders and servicing agents have set guidelines and are under contractual agreement with investors to meet guidelines. I have heard of people charging $1500-$5000 for this service when the people are in no position to pay this.... All they need is a little help to put together the hardship and process the package.

I have a question which i would like to share here! Can my missed payments be added back into my new loan modification? I mean will the arrears be added to the new loan balance and spread out over the term to allow the loan to be brought current.
