One of my friends had their home vandalized by some minors over one month ago.

The police caught the kids the second time that they hit the home and filed a police report and the boys went to jail until their parents picked them up.

My clients are down south because their snow birds and they go down for 4 months to get out of the cold weather. The police never contacted my friends and told them their home had been broke into. Also after the break in the police had made their report the back door had been left wide open for almost one month.

The minors broke windows, kicked in the door, turned over furniture and broke very valuable collector antiques. The home owners policy covers up to $45,000 dollars for personal belongings. My friends valuables are worth around $150,000.

Can my friend try to collect money through the minors parent's home owners policies?

My friend is very upset about the incident and has contacted a attorney.

And wanted me to ask my friends at Activerain what options they have.

My friends are not sure if they will be able to live back in their home that has been vandalized so I may have a listing from the incident, but it sure is a bad way of getting a listing.

If you know anything about home owner insurance policies, could you please help my friend with some advise.

 "Thank you"

I don't know the answer to that but the parents would be liable.  I can't imagine a insurance policy paying off for policy holder to do criminal acts.  So I would doubt it.

I'm not an attorney, but I would certainly look into going after the parents, and the police for not securing the property.

Sounds like a lawsuit against the parents to me.  Also sounds like they should have had more coverage on their valuables.

As far as the police go, I don't think it's the police's responsibility to secure the property and unless they left contact info at the house, how would the police know where to find them to make notification?  I'm surprised they didn't have a friend or neighbor looking in on their house for them during their vacation ... 4 months is a long time to leave your property unattended.

Good luck to them.

#1. Why do people under-insure property. Do we only get health insurance for 1 arm or 1 leg?

#2. Call the local police and let them know you will be gone with contact information. Surely they have a friend who could check on the property every week or two.

#3. People sue for anything and everything.

I don't think the minors parents insurance would or should pay.  But certainly they could sue them for damages beyond what insurance is paying and their deductible.  And it does seem odd to have no one looking in on your property in 4 months.  I have someone look in on my house if I'm gone longer than overnight.

There were neighbors watching the home while they were gone and they are the ones that called the police when the minors were doing damage. Because it is a small town of only 1500, the police protect the children because they are friends with everyone it town.

In that case I would be suing the parents.

If neighbors allowed my home to be open for over a month....I might find new neighbors! Didn't the neighbors know how to get hold of the owners? Duh!

Sherry - Thanks for coming around and I couldn't agree with you more. Most of the people in this small town of 1500 are interbred.
