Maybe You Should Run A Background Check On Landlords-Tenants Beware!

Sounds extreme right?  Think again...

Scenerio 1

Just imagine if you were a tenant trying to get into your home on Christmas Eve..gated community and all of a sudden you can't get into your house..neither can your room mates.  Imagine the stress a mother feels..when her son is so far away..she does her part and calls all her connections he and his room mates gets back in and before you know it..they find out...No tenants allowed..they had a lease and now..there is an eviction notice..on the door but not before the landlord fabricates a story...a story to the HOA..and the tenants don't want to take part nor does the mother... 

Now the landlord is upset because it could have worked if only the tenants had gone along with the story and now without a choice the landlord must evict these young men.... they are now looking for a new home for the boys!

Scenerio 2

While there are record numbers of short sales on the market... you have to wonder, how many of these properties are on the market for rent today? And what is the get current on the mortgage and continue paying..or will there be more stories of tenants with eviction notices on the door?

Tenant Beware It Could Happen To You!

I don't necessarily mean do a background check but maybe everyone should do their homework...

Tenants usually pay first last and security...they sometimes have their credit pulled..background check done..a determination is made if the tenant can pay the rent....they go through quite a process...and maybe so should the landlord!

We have renters where the landlord is not paying their mortgage -- and the renters are  being caught unaware -- sad state of the times.

That is one thing that pisses me off.  When a landlord takes the rent and doesn't pay the mortgage... they should be looking at fraud charges and jail time.

Midori, can I say this is wisdom in this market. What a terrible scenerio to have been put in. Good idea to check tax records and bank and make sure the seller, not lessor is current on payments BEFORE you move in.

Midori - The sad thing is when a good paying tenant looses all the monies paid to the Landlord (Security Deposit, Pet Deposit and Last Month Rent) and have to pay it all again. "It is time to buy your home now!"

Hi Midori,

I have read a number of cases where the Landlord had absconded with the tenants deposit and security. All the while collecting rent and not paying the mortgage. Eventually the home is foreclosed and the tenant is out in the street and no home of getting his upfront money back.

Some bad landlords give the industry a bad name.  It is very difficult to know who to trust as one looks good today can go south tomorrow no matter how good it looks today.  That is the nature of renting, especially houses and duplexes.

Worse yet... I've come across tenants contacting me in the final days of being evicted by a bank who paid a security deposit and monthly rents to somebody who did not even own the home!

Very common story that I hear in my area. I almost had one of my landlords not tell the tenant but we were lucky and the tenant moved and we found them another place.

I doubt if 90% of tenants know what a lis pendens actually is.....and many states/jurisdictions don't treat a forclosure as a lis pendens - the notice is included in the actual note or security instrument originally recorded with the mortgage.

Having a title company run a courtesy 2-page title report is a better option if they can wait the 24 or 48 hours for the process.
