Here's a topic brokers should probably discuss during the regular office meetings. It's a gentle reminder, and a reinforcement of truth in advertising. And that includes online advertising.

TRUTH IN ADVERTISING LAWS

From www.Business.gov, here's a link to Truth-in-Advertising LAWS that states:

"Advertising laws are aimed at protecting consumers by requiring advertisers to be truthful about their products and to be able to substantiate their claims. All businesses must comply with advertising and marketing laws, and failure to do so could result in costly lawsuits and civil penalties. So before you start an advertising campaign, it's important you understand some basic rules."

The Federal Trade Commission (FTC) is the main federal agency that enforces advertising laws and regulations. Under the Federal Trade Commission Act:

  •  
    • Advertising must be truthful and non-deceptive;
    • Advertisers must have evidence to back up their claims; and
    • Advertisements cannot be unfair.

Yes, there are guides against Bait Advertising "an alluring but insincere offer to sell a product or service which the advertiser in truth does not intend or want to sell. Its purpose is to switch consumers from buying the advertised merchandise, in order to sell something else, usually at a higher price or on a basis more advantageous to the advertiser. The primary aim of a bait advertisement is to obtain leads as to persons interested in buying merchandise of the type so advertised.

DEFINITION OF FALSE ADVERTISING (from Wikipedia) 

False advertising or deceptive advertising is the use of false or misleading statements in advertising. As advertising has the potential to persuade people into commercial transactions that they might otherwise avoid, many governments around the world use regulations to control false, deceptive or misleading advertising. Truth in labeling refers to essentially the same concept, that customers have the right to know what they are buying, and that all necessary information should be on the label.

Bottom line, regardless of which media one uses, print, broadcast, or the internet, the same cautionary principles should apply about engaging in false advertising.

REALTOR CODE OF ETHICS

Refer to Article 12.

REALTORS® shall be honest and truthful in their real estate communications and shall present a true picture in their advertising, marketing, and other representations. REALTORS® shall ensure that their status as real estate professionals is readily apparent in their advertising, marketing, and other representations, and that the recipients of all real estate communications are, or have been, notified that those communications are from a real estate professional. (Amended 1/08)

In my recent post, I lamented about an agent posting for sale on Zillow some listings that have already sold. This is a clear violation of Standard of Practice 12-4 that states "REALTORS® shall not offer for sale/lease or advertise property without authority. "

Ethical dilemma: could/should you re-post SOLD listings as ACTIVE to get internet market presence?

Since we are required to complete the Code of Ethics and Standards of Practice, this is a good reminder of our obligations to be truthful. And that includes truth in advertising.

Alexander --- which blog by Jason and Richard L. how did I miss those. We should reinforce these things. So even if we repeat the message, it's worth repeating ad nauseam until everyone gets it right. Bottom line: bait and switch advertising is illegal. And since realtors are always being accused of being dishonest and unethical, it's up to us to change that image.

That's an endless topic to discuss. Well written and great graphics. Here is the problem: too many Internet portals using our listings and information. In many cases absolutely no way to change or delete the wrong information - like change totally out-of-date 3 yrs old agent's profile on some sites. Apartment with greart view is a great reminder to be careful with information published by agents or with agent's name attached.

Thank you for your timeless piece Pacita, as a 24 year veteran I have seen lots of things that will make me duck and run for cover while seen how a dear colleage exposes himself/herself to a huge liability and risk everything for almost nothing. This is a dangerous topic NOT TO Discuss. The opportunities to make a mistake abound on every transaction, why make some on purpose?

Tamara --- in advertising, we have a mantra: tell it, then tell it again, and tell it again. We should do the same about truth in advertising.

Svetlana --- we do need to update our profiles, pictures etc. But on sites where you personally upload information for properties for sale, such as Zillow, postlets and Vflyer dedicated to posting properties for sale, it is incumbent upon us to update everything we post. To deliberately post something that is not true is definitely a breach of ethics, advertising laws and MLS rules. Right?

Pacita - Buyers have become very savvy.  They no longer fall for misleading property descriptions.  Most of them seem to follow the rule, 'If is sound too good to be true.....'.  The best exageration I heard this year was from an agent selling her son's home.  It was very small with a horrible floor plan.  She liked to say, 'This house hugs you'-----when really it should have been, 'This house strangles you"!

Pat ---- metaphors are indeed an agent's marketing tool, but sadly, some folks have just gone overboard with sales fluff. We may be guilty of sales fluff to a degree, but deliberately advertising a house for sale when it isn't is an outright lie.

Yes Realtors have a way of spinning things in a positive nature.  As long as it's truthful it is ok.  Cross the line and that is where the trouble starts.

Great Post!  Makes me think of a certain unnamed full-service brokerage that advertises to sellers, "Sell your house for $995",  with not a disclaimer or terms and conditions anywhere in sight.  In actuality the seller has to sign an entire page filled with terms and conditions if they do list their property with this particular office.

Pacita - This is a hot topic for me right now.  It's incredible and appalling how some agents that are clueless when it comes to Short Sales boast of hundreds of transactions and high closing ratios - neither metric being supported by the MLS.
