Simple question that often goes unasked, Are you Working with a Realtor?  A duty for all Realtors to ask when they receive an inquiry on a home or engage in conversation at an Open House.  The question that can save a world of time, emotion and disappointment.

How many times do you hear the "whine" from an agent about showing a home and spending a lot of time with a buyer just to find out that they were working with another agent?  Yes, the buyer should be working through their agent but being realistic we all know that they go to open houses, call and want to see homes when they are not able to connect with their Realtor.  By asking "the question" clarification would be defined upfront and a business decision as to opening the door for them to a listing can be made. 

Wait, I know of the naughty buyers that are not truthful when they are asked if they are working with a Realtor and they say No but they are.  I also know of naughty Realtors that send their buyers out looking and telling them to let them know when they find a home they like and they will write up the offer.  Those scenarios are posts in themselves.  Nothing we can do about dishonest responses but accept as professionals that these things happen.

What curls my toes are stories of agents who know that a buyer is working with an agent and they proceed to plant the seed that they would be so much better of an agent to represent them due to location expertise, etc.  Now that is unprofessional and also an ethical question as well.  Respect for each professional in the business is what we should strive to maintain. 

When asked from a buyer about how to break a Buyer Representation Agreement with another Realtor, now that is also an ethical fine line as well.  I generally tell them that they need to discuss with their Realtor why they have an issue and try to resolve it.  They are under a contractual obligation that is a two way instrument.  They certainly should talk to the agent and the broker.

Best advice ... you need to work with Your Real Estate Agent and I would love to work with Your agent as well.

Great post Connie. I made it an instinctive response question to the 1st question I am asked by a potential client / buyer. Are you working with a Realtor? It is a curious thing how some of the more simpler common sense parts of being a Realtor turn out to be problematic. Let's treat eachother the way we in return would like to be treated. No?

Another scenario I run into is that the "potential buyer /customer" is telling the truth when they say that they are not working with a REALTOR. However, they show up with their parentsto tour the home at the appointed time, and the parents announce that they have a long time friend or relative that they work with, and advise their children. At that point, anything you may say seems to get misconstrued as self serving. Next step can be to ask for a referral but that gets pretty ugly pretty fast too.

No matter how careful one can be it is always possible to get tripped up regardless of what questions we ask. The main reason? As Realtors we are held to a strict code of ethics, but the general public is never held to any code of ethics.

You're right, it is an important and often forgotten question.

As for the "planting seeds" comment, that is not only not professional it is against the code of effects. Period.

That happened to me. I had a listing that was priced to high but the client would not come down. another Realtor that happened to be in their neighborhood told them I should be having wine and cheese parties for Realtors so the Realtors know their house is for sale. She went on to say that would have been the first hing she would have done and made me look incompetent. They terminated agreement with me and went with her. They never sold the home and I never got invited to the wine and cheese party.

Hi Connie

Asking the customer if they working with another Realtor is one on the most important question that you can ask the customer because the answer sets the tone for the type of relationship you may or may not have with the customer.

We require that a buyer's agency agreement be signed BEFORE anyone is taken out.  This is not only for the agent's benefit (it provides a course of action if the client buys through another realtor), but it also a) saves the agent time by not investing resources in someone who is not serious about working with them, b) allows us to get the buyer pre-approved before they go out house hunting and (most importantly in my book) c) protects the safety of the agents in that it brings the "customer" into our offices, we take a picture of his/her identity (for buyer's agency - we want to ensure the person signing is the person saying who they are), and if the "customer" had ulterior motives....well, let's just say they usually will not solicit any of our agents.

Signing a buyer's rep agreement certainly would define duties.  Unfortunately many Realtors do not have the deligent practice of the buyer agreement and sometimes when they do buyers still ignore.

Hi Connie, I even ask sellers who contact me if they're working with a Realtor - sometimes they are, sometimes not. It gives me a chance to connect with their agent as well as refer the seller on to someone I know and trust.

I learned this one the HARD way after doing exactly what you are describing - spending time with a "buyer" who just wanted to see a house while their agent is on vacation. Ugh!

It is a sad that we have to deal with some shameful people.  We just have to focus on the wonderful ones that cross our paths.  Sorry for your experience and unfortunately I have several stories from several years of selling.
