
Realtors must perform ethically. We hold a license and are held to the highest degree to adhere to our ethics. Wouldn't it be great if our clients, sellers & buyers, had a code of ethics that they must also comply? In a manner of speaking they do have contractual responsibilities that they sign agreement on our listing agreements, buyer representation agreements, contracts, etc. If they fail to perform on their agreement then the consequence of a law suit becomes a possible punishment. Although I believe we all agree that a law suit tends to punish both parties inclusive of the innocent and the winner generally are attorneys. I would love to see a code of ethics for buyers and sellers that they must read and sign as part of their relationship and agreement with a Realtor. A code that clearly defines responsibilities with absolute clarity. Duty to disclose defects in properties for sellers, buyers have a duty to be loyal to their Realtor, etc. A booklet beyond what our contracts brush over. A code that would make a client think twice before inappropriately acting.
Enforcement would be a huge problem and a governing body to enforce would be politics at its finest. The goal is to remind our clients that they are held to a standard just as we are held. This may be a someday occurrence but for now maybe just providing your clients with a copy of the Standards and Ethics for Realtors and then handing them a client commitment agreement that you have authored. A commitment for their responsibilities as you expect from the relationship and your signature that you will also fulfill your responsibilities as well. Your own Code of Ethics. It certainly would define expectations of the relationship so all are on the same page.
Connie, great idea. I'm sure most if not of your clients are ethical but when you run across that one thats a little bit over the line well the book sounds great.
