Never, but most certainly not when a real estate agent decides to say it is not a condominium.  That determination is made when the builder develops plans, files for construction permits and the project is approved.

Here in Prince William County there is a subdivision named Potomac Club Condominium - it consists of hundreds of homes - every single one of them is a condominium - there are no exceptions

Today, while performing a client search for homes in Potomac Club I found several properties classified as "fee simple" properties.  Fee simple means they are not a condominium.  Why do agents do this when the entire community consists of condominiums?

  • They are unaware of what constitutes a condominium - it is a form of ownership, not a form of architecture or
  • They are misrepresenting the property trying to get more traffic by leading people to believe it is not a condominium since there are many purchasers who will not consider a condominiuum.

In either case they are not

  • Serving their client well
  • Serving the public well
  • Serving the real estate community well
  • Serving themselves well

This happen in Austin, Texas too and I would NOT be surprised if it was prevalent elsewhere. The problem always goes back either inexperience or possibly laziness on the part of an agent. I know this has been discussed ad nauseum but no mater the amount of time in business an agent should make every effort to learn and know as much as possible abut any transaction! Russell,  It is either inexperience, laziness or downright misrepresentation.  When you see it on a listing by a broker you may be inclined to consider it misrepresentation.  As brokers, you, Karen and I know better.  After all, it is as plain as the light of day on the public tax record and I am confident the property owner is aware that it is a condominium.  The thing that tickles me is I usually run across it being done by one of the "holier than thou" real estate agents that are the first to criticize others.  As my dear old grandpappy used to say. "Mortals who abide in vitreous edifices should not possess morbid propensities toward disestablishment."  Your hello has been delivered.  Art
