The Path of 'Leased' Resistance

 

Have you ever been chased down by an angry tenant of a home that is For Sale? I have to admit, it's not on my list of Things to Do! My client and I arrived at the home we were to preview and was greeted by the tenant's teenage son who said they needed 24 hours notice and that we would not see the home that day. (I later found out the Realtor's assistant called the owner of the home instead of the people leasing the home!)

 

We left and continued looking at other properties down the street when the father pulled up in his car and wanted to continue the conversation where his son left off. This man started off polite but somewhat aggressive in his manner. I was standing on a sloped area and found myself backing up in order to put more room between us. The man was angry, said the owner did not communicate his intention of selling the home, did not want a sign in the yard and was not showing the house to anyone!

 

How would you handle this situation?

I would of told him to speak and get angry with the homeowner, not you. You had nothing to do with that situation.

I would tell him that I was just the showing agent and he needed to contact the owner directly, while I was heading to my car (and safety!)

I would call the listing agent and let them know what happened.  They need to be aware of a potential personal safety issue and talk to the owner about whether having the property listed while the current tenant was in place was a good idea.

He needs to speak with the owner and get things settled as to what the owner intends -- and then depending on the laws in your state as to how much notice a tenant needs -- agents have to give that time to the tenant.

Wanda, Yes, I have been in that position.This is the reason that I make my own appointments. If the listing agent was on top of this, you would not have been in this embarrassing/dangerous situation...at least not without warning

 There are ways to handle tenent occupied properties. I just read in the MLS remarks " Please work with us on showing appointments. Renters prefer after 5pm and weekends"  I thought this was one way to alert the buyer's agent.

I would apologize to the tenant and advise him that I will be contacting the seller as soon as I finish up with my clients and get to the bottom of what I believe is a misunderstanding.

The listing agent's assistant (his wife) called the owner rather than the renter to schedule the showing and the owner failed to notify the renter. He was upset and rightfully so but took his anger out on the wrong party Kathleen Daniels.

Hello Wanda - a trip in the wayback machine lead me to finding this post.  Your cleverness in post titles was evident then as it is today.  As for the subject matter addressed - tenant encounters during real estate can be treacherous at times.   Proper communication and respect can definitely help but that's not always the case given the circumstances.  Sometimes it's best to simply "move on".

That was quite the experience and I had a few words with the listing agent about relaying communication to the proper party. That could have ended very badly!

Here's another comment on your first ever ActiveRain post.  The path of "leased" resistance - I probably would have said something along the lines of "That must be so frustrating! I'll let the listing agent know he needs to contact the owner and share your concerns" or some such stuff. I'd also probably let him know I didn't have the owner's number so couldn't contact him directly. What a mess!

Well you knew I just had to come back and read your very first post Wanda!  Your title was spot on - a professional from the git go.  Way better than my first one but that didn't stop me!!  I think mine was something like - Are you loving the media?   Still could say that to this day!  LOL

 

As for the jerk tenant.  I'd get out of there - as in pronto.  I did have a guy who wanted to rent a town home from me get very angry when I told him that a credit report etc was required.  I went to the door and walked out into the driveway hoping others were out an about.....didn't want to be stuck dealing with him getting stupid.

The media has not changed one bit Anna and may be even more aggressive in their hate agenda's. As for that potential tenant...did he think you'd rent to him just because he showed up? Safety first!

This was something that could have easily turned even more serious Kat Palmiotti, even though I was backing up, taking a less aggressive stance. My one client was already heading for my car as the conversation got a little heated on the tenant's part. I did call the LA as soon as I dropped off my client, discussing the situation!

The tenant was mad because he didn't want to move and felt that the owner of the property pulled the rug out beneath him/the family. His misplaced anger fizzled out quickly once he realized I wasn't playing Anna Banana Kruchten CRS, Phoenix Broker! He was one aggressive step away from a 911 call and my husband was very unhappy when finding out about the incident.
