OPEN LETTER to my California Title Company Reps who are under the strictest title marketing rules in the nation

Our California title marketing reps are restricted from doing a lot of things many of them used to do to boost business. See: What a title marketing rep can/cannot do. Even as a friend? Paid out of his own pocket?)

This letter is for California title marketing reps:

My dear Title Marketing Reps:

You don't have to buy me lunch. No cocktails. No knick-knacks, no presents either. 

You should know what I value. Through the years, what I truly appreciate that you do for me are:

  • Your keeping me grounded. When I have too many balls in the air, you help me focus and concentrate on marketing my services.
  • Your active participation in our Local association events. Thank you for your help in organizing many of our events. It's also so much fun to see you being one of us, joining in the silly skits that put on during our officers' induction ceremonies. The more we see you, the more we appreciate you.
  • Your stepping up to the plate whenever there is a problem with an escrow. I know you're restricted in what you can do, but the mere fact that you are willing to get involved, follow up on a problem that a title company can resolve. Follow up is extremely important, and it's nice that I can count on you.
  • Your creative ideas. Thank you for coming up with some really creative ideas to help me market myself better. Thank you for spending your time strategizing with me on choice of words that seek to enhance my marketing materials.
  • Your telling us about new tools of the trade. Sometimes, I get so buried in my work that I neglect to "sharpen the saw". Thank goodness that you are there to alert me to new seminars, new tools,  etc. to help me get better or to keep me informed of new rules and regulations.
  • Your reminding us of new laws and ordinances before and when they go into effect. You keep me on my toes, and out of trouble.
  • Your guidance in building a list of resources. When I was a newbie, you encouraged me to build a network of resources and people on whom I've learned to rely on for so many things. I have since compiled my own list, but it's nice to get the jump start from you.
  • Your positive outlook. Thank you for empathizing when things are not going so well. And thank you for steering me towards the light, to stay positive.
  • Your making time for me. Even though you have a ton of clients, you still make it a point to call and see me on a regular basis to see what else you can do for me. Follow up is a critical element of this business, and you do that so very well. And when you do come or call, it isn't a cursory "hello, how are you doing. Just checking in" kind of call. You always have something new and exciting to share.
  • Your not taking any other calls when we are in a meeting. Except for extreme emergencies, you always focus on what is at hand, and make me feel really special.
  • Your friendship and for your continuing role in growing my business.

And may I say that you are not merely a resource, you are a friend and a partner!

Wow!  That is very generous to not mind being the primary rainmaker for an entire multi-billion dollar industry.  I know that things are not allowed per RESPA, but I do expect more from those who earn MY business than just showing up and doing the job they are paid for.

Ron --- what kinds of things can title reps do for you in Texas?

I'm afraid our reps in California are so restricted they can't even offer to buy a cup of coffee. At their office, if they offer water, it has to be from their water dispensing machine (can't be bottled water). I was never a beneficiary of trips to Las Vegas or a new electronic gadget, but my reps have helped me ten-fold in building my business that I should take THEM out to dinner and cocktails.

I've also heard from some agents who have told me that their reps don't do the same things for me that my rep does.

Pacita,  RESPA is not statewide in scope, it is National.  If you read the RESPA guidelines, there certainly ARE things that title companies can do but I find that a lot of them will take RESPA and hide behind it...I mean, c'mon water from a bottle vs water from a dispensing system (that is cheaper)?   Do you really think that is covered in RESPA or is that a TITLE company with a way to cut costs?  Just a thought...and by the way, I have SEVERAL title agents and companies that I like to use!

Ron,

Mike Mueller sent me an email the other day and he advised that guidelines in California have gotten much tighter in regards to what a title company can and can't do, so I can believe that they can no longer give bottle water to agents.

Ron, please refer to California's SB 133. See this link to a general description of its provisions http://www.clta.org/for-members/legislation/2008/brochure_sb133.pdf. It's the strictest law on rebates.

I thought I was very specific in referring to my California title reps.

Bottled water is considered refreshment (not any different from a bottle of coke or wine).

And...I do use at least three title reps. I sent this open letter to all three, and they will recognize themselves and the level of their service.

Hope this helps clarify.

Tony, thanks for your comment. RESPA is national, as Ron says, and we acknowledge that. And you're right. California has gone beyond that, and probably has the strictest rules in the nation.

Ron-

I think it is a combination of RESPA and state insurance rules that are restricting (us) title companies.  We aren't even allowed to put a dish of mints (or even gum) out on our table at a convention (because they are considered edible).  Believe me when I say- it's not the title companies who are restricting themselves.  I don't believe we (as title companies) should be allowed to pay for surveys or send agents on cruises, but when we can't even help our clients with marketing (as in loan leads or mailing labels), it really limits what we can do to help our clients in their success.

Amy --- my reps are so nervous about these new rules that when I invite them for lunch or cocktails, they're hesitant. I have to say that after hours, we're just friends. And for gosh sakes, let ME buy!

Now that SB133 has been in effect for awhile,  I wonder how the California Realtors feel about it.  How about the Title Reps.  It seems like it has become difficult for Title Reps to "stand out" and proactively develop business.

I am gathering opinions as I try to develop web based solutions for the SB133 dilemma.

My reps have proved themselves to be invaluable in many ways. Their gift to us is their gift of time, of lending an ear, of helping resolve a problem, of making suggestions, of alerting us to new ideas and marketing tools that can help us.
