I don't have an answer but wanted to see what others say so I jumped on board.
I assume your question is from the Listing Agent's side (the question may be inappropriate if you are representing a tenant).
I believe any question related to the home is appropriate because you need to know as much about the motivation of the landlord as you do about the condition of the property. Afterall, your objective is to get the property sold/leased as soon as possible and, in order to do that, you should be presenting a solid marketing plan that takes into account timing and urgency issues.

I would think in our current market it would be a very legitimate question. It isn't a violation of any far housing laws and considering the number of stories we are hearing about tenants finding themselves on the streets when the landlord goes into foreclosure it seems appropriate.
