Eeyore would probably be perfectly content with the information I'm about to share with you.  However, some of my friends and associates will most likely think this post is leaning to the "doom and gloom" side of things.

The intent, however, is not for this to be perceived as negative information, or to elicit feelings of sadness or depression.  And it's certainly not to be construed as "The sky is falling!"  Rather, the intent is to make my Arizona clients and fellow Realtors/Brokers aware of an eye-opening source of information that could prove to be invaluable to all of us!

I remember just a few years ago when it was considerd tabboo to discuss the financial status of a specific builder.  And yet, due to the rapidly changing real estate market, the Arizona Department of Real Estate has posted on their website a public document wherein you can find a list of all the builders and developers in Arizona that are in financial difficulty, foreclosure and/or bankruptcy. Here's a sample page:

According to the ADRE, "Homebuilders who end up on this list are required to place and hold all earnest money and down payments in a neutral depository."  You can view the enitre list by clicking on the above screen shot (chart image), or here.

Now this is my point ~ if I'm looking to purchase a new construction home anywhere in Arizona, or if I'm a Realtor who is working with and assisting a client in searching for and contracting with a builder for a new house, don't you think it would be a VERY wise thing to consult this list first (which us being regularly updated) before entering into a new contract?

Yes, it' a sad thing to see 6 pages worth of troubled builders, but most of the builders out there are NOT in trouble!  So while it may seem like a 'bad news' document, I personally see this is as excellent source of information that could potentially save a lot of us a lot of heartache and money.

Hey Mike...  the funny thing is that there is a MUCH longer list of builders that are very much alive and well, and still building houses!  The pricing is incredibly attractve.  I just wanted to encourage folks to make sure they're dealing with a reputable builder, and for Buyer's Agents to do their due diligence.  BTW, my name is Randy.   :)

Teri ~ I was more than surprised by Fulton filing for Chapter 11 - I was shocked!  But there have been a couple other builders that filed for Chapter 11 and then came roaring back.  So if the after-shocks don't hurt 'em too bad, maybe they'll recover.  ~~ regarding AR, I've been racking up points like a wild man while you were 'locked out'.  I think I'm almost there!  LOL   Seriously, that's a bummer, and I miss you on here.  Hope you're back, soon!   :)

Jane ~ I was wondering if other state real estate commissions were publishing lists like this.  Will you let me know if you find anything like it in CA?

Yes, I will Randy.  I know of one builder here personally who had their project go back to the lender which happened to be B of A.   B of A actually took over the project, finsihed the homes.  I sold one and they were actually very easy to work with.  They did not even require my buyer to use them, B of A as the lender.   Very cool, since I got this client from a lender friend of mine and the buyers were able to use him.   :)

Jane, that's EXACTLY the kind of stories more people need to hear!  So many peple still 'freak' when they hear the word bankruptcy, but in reality, if handled properly, a company that rises from bankruptcy is like the Phoenix rising from the ashes!   :)

The new home builders are really cornered by this market. Their competition used to be existing homes... now it's foreclosures. It's just amazing how low the prices are on new homes... the builders can't be making much money on them.

Hey Chuck... I've been saying that for over a year.  There's just no way somem of the builders can be making ANY profit on some of the offerings I've seen.  It makes no sense for them to lose money on any given sale, and the only thing that makes partial sense t me is that they are literally trying to generate cash flow.  And I agree ~ foreclosures are everybody's #1 competition these days.
