There is a thorn in my side and I have been on a mission to get the correct answer to something. 

I will start by saying that I live in Connecticut. I was the seller's agent (the listing agent) and my  (builder) clients closed on a new construction home at the end of 2008.  The buyers got a VA loan. In the beginning of the loan process the buyers were told by their lender to get a termite inspection of which they did and there was no evidence of termites or termite damage.  The buyers paid about $100 for this inspection.

A week before the closing date  we were all told that the seller must have a termite treatment done at the seller's expense.  The pest control company estimated that this would cost about $1,300. 

The lender went back and forth about this and a day later I was told that termite treatment did not need to be done. 

However, I got the final call and was told that:

YES, even here in Connecticut, a termite treatment needs to be done to satisfy VA loan requirements according to this loan company's underwriter. 

Since the home closed in December and the ground was frozen it was not possible to do a termite treatment according to the pest control company, (which makes sense).  To solve this, the $1,300 for the termite treatment would need to go in an escrow account and in springtime a termite treatment would need to be done to satisfy the loan requirements and this is exactly what was done.  (So that money is still sitting there in the escrow account).

I must point out that $1,300 was a big expense that was sprung on my seller/builder at the last minute. 

Here is the question:  

  • Is it true that a VA loan requirement of a new construction home must have a termite treatment in Connecticut for the VA loan to go through?

I've been asking around and have gotten mixed answers. I just want the right answer.  I know there are some VERY KNOWLEDGEABLE lenders out there and I want get to the bottom of this.  Thank you for your time.

I recently closed a sale with a VA loan in Hawaii and there were no requirement beyond the normal termite certificate. No termies/no treatment. It sounds like your lender was struggling a bit to understand the requirements and maybe he just chose an abundance of caution? I don't know why Connecticut would be different for a national loan program.

What a great question. I too would like to know. Here in California we are always dealing with the lovely termite scenario. Now with more FHA and VA loans being obtained, I would like to know if it is type of loan specific or if it applies to majority of underwriting requirements? Let me know what you find out. I find it interesting that the buyer paid the original inspection fee. I know all things are negotiable and it depends on what is agreed to. I also find termite inspectors inspections are free no cost no obligation here in California. Just thought I would share.

In my area, builders treat the ground before construction begins. The cost is then about $250. VA also requires that the seller pay for a termite inspection, cost about $50. VA does not permit VA borrowers to pay for termite inspections.

Dawn, I am not a lender and with all of the changes that are taking place with lending requirements these days it is hard for me to keep up with it all. I hope that this lender was right however I need to know for sure.

Dawn, Ditto Lenn's comments above but as a seasoned VA guy and new construction specialist I do have to fill in some blanks before giving you a definitive answer. You mention it was your builder that sold it so I assume the home was never previously occupied. Do they not treat subterranean termites up your way? Also how long ago was the home completed? That's important because even if your builder did a treatment the bond is usually only good for one year unless renewed. If the home was covered under a termite bond, evidence of that should have been enough for the underwriter. There is also a form the pest company completes (Wood Infestation Report, NPCA 99a and 99b) but again that's in regards to the pre-treatment. Bottom line is this, if the treatment isn't customary for your area the u/w was just being harsh. There is no VA requirement for it unless there is evidence of termites, and you said the WDO came back clear. Unfortunately it is one of those cases where underwriter discretion can mess things up. Dawn, In my VA handbook I wrote (in a training session with VA trainers) that termite inspections are ONLY required in Utah and New Mexico (!) The lender may have had concerns over recent episodes of termites on other properties in your area or their own portfolio. Lenders have 'overlays' that may not be a VA requirement but their own underwriting issues. They can ask for most anything but the VA would be very concerned about costs to the Veteran borrower ever... usually the seller or realtor forks out in this situation. As brokers we pick up a lot of costs ourselves, including underwriting fees!

Dawn, I would add it might be useful to speak with your county or city permitting department as they could have termite ordinances for new construction--VA or otherwise!
