I am sure pretty much everyone involved with social media or even anyone remotely familiar with the internet heard about Facebook’s supposed change in their TOS. (Terms of Service) I purposely said supposed and italicized it because apparently it was just not true and not even slightly true. The fact is that absolutely nothing changed and it appears that the Consumerist was actually responsible for creating this rumor. Furthermore they never even contacted Facebook regarding the supposed changes.
When you are writing an article have you ever had a complete change of heart? You can see where I was going with the first part of this but after reading many of the great comments below the article I was linking to I have changed my mind. I actually disagree with this interpretation of the Facebook TOS and have to agree with the comments below. To summarize an idea presented, it’s like a used car salesperson getting you behind the wheel, they will tell you anything to buy the car and that’s what this interview with the Facebook staffer was. It’s pretty clear to me this was intentional and I would find it hard to believe that they didn’t know what their intention was when they released the new TOS. In reality it seems as some of the comments have suggested that the new TOS were meant to be overlooked and it seems just by chance that this came to light. The new TOS in fact could have very far reaching implications for many people including professional photographers as was pointed out in the comments. I actually think this was a pretty good debate and I would certainly be interested in seeing that carried over here.
So what do you think? To highlight the debate should a TOS really have such far reaching implications? Shouldn’t it be there to guide the community and to protect the community but not to trump the rights of the individual’s right to privacy? Sure it can be argued that the website is owned by the company that created it but is the content not owned by the people who willingly shared it?
I intend to write another post related to the issues of TOS and your rights online because I feel it is important.
