The agenda has been released for the next Washington State Home Inspector Licensing Advisory Board meeting. Primary topics include:

L&I speaking on the rules, as far as home inspectors removing covers from electric panels.

Discussion about what procedures will be implemented for approving education courses -- both the fundamental courses and continuing education.

Anyone who is interested, and wishes to attend, should be at the Double Tree in SeaTac on Thursday, March 12. The meeting is in the Olympic room #1 and begins at 9:30AM. The Double Tree is located at 18740 International Blvd. See you there.

I believe that, at the public hearing on standards, someone questioned this. As you know, we have been doing this for years as part of various inspection association standards. But, once it is written into the law, I guess they have to be absolutely certain it is legal. Everyone assumed so but one law cannot conflict with another. So we need to find out for sure that L&I does not have some rule saying only the homeowner or the electrician can remove the cover. Our standards of practice are modeled after other association standards so I think none of us ever questioned that this could be a problem. Guess we will find out.

Steve,

I took a few minutes and went digging at the L&I site - I don't see anything that prohibits us from removing the cover to the panel.  RCW 19.28.261 Exemptions from RCW 19.28.161 through 19.28.271 has a provision that states

Nothing in RCW 19.28.161 through 19.28.271 shall be construed to restrict the right of any householder to assist or receive assistance from a friend, neighbor, relative or other person when none of the individuals doing the electrical installation hold themselves out as engaged in the trade or business of electrical installations.

I think that this will cover us pretty clearly.  The definition of work will probably help as well as it doesn't specifically define removing the cover as part of the standard that applies to contractors.

It is unlawful for any person, firm, partnership, corporation, or other entity to advertise, offer to do work, submit a bid, engage in, conduct, or carry on the business of installing or maintaining wires or equipment to convey electric current, or installing or maintaining equipment to be operated by electric current as it pertains to the electrical industry, without having an unrevoked, unsuspended, and unexpired electrical contractor license, issued by the department in accordance with this chapter.

We'll see.  I'm hoping we're just cross t's and dotting i's.

Yes, we hope it is that simple. Hopefully we will not need the homeowner to sign something or another stating we are "giving him assistance." Seems that would do it, of course we are usually really assisting the buyer. But it ought to work out.
