A few things I have learned over the years working with distressed real estate that not everyone can claim:

1. Never change a HUD once it has been prepared by the title company.  Unbeknownst to the seller, this increases the homeowner's deficiency balance putting them at greater risk and open up the title company and the broker to potential law suit.

2. Disclose all of your fees up front and have all parties involved acknowledge them in writing.  

3. Sellers need legal help but most are not in a position to pay for these services.   Find a way to provide legal services to all your sellers free of cost.  This also eliminates liability to the broker when an attorney is involved.  Despite common belief, an attorney is required when negotiating with the banks regarding a deficiency balance, promissory note, and the like.   Never close a short sale without addressing these issues with your seller.   

4. Agents are looking for instant, time, date, stamped status notes for every file and they want to be able to access this information 24/7.  Software isn't cheap but it goes a long way.

5. Most agents don't know much about things like HAMP and HAFA.  A well-informed agent makes a successful agent.  Keep your agents in the loop regarding updates on rules and regulations.
