Business Law for Real Estate

B-Law recognizes the unique needs of the real estate investor and the real estate agent. Being involved in real estate, either as an investor or an agent, necessitates thinking like a small business owner. The key to making the step from real estate as a hobby to real estate as a profession is the development of a business plan. Part of the business plan should be an asset management plan, to manage your real estate and non-real estate assets during your lifetime, and an estate plan, which will manage your assets and distribute them among your loved ones after you have passed.

The Business Plan.  A successful investor or agent will have taken the time to draft a five-year business plan. The plan should address the following issues:

1. What is the focus of your company? How do you set yourself apart from your competitors? What advantages do you have over your competitors?

2. What is your plan for growth during the next six months? The next year? The next three years? The next five years?

3. What is your marketing strategy? Who are your target clients, and how will you generate business from your target clients?

The Asset Management and Estate Plan.  An effective asset management plan ensures that your assets are working for you, rather than the other way around. Once you have begun to acquire assets, how are your assets protected? At your passing, will your loved ones have to go through the lengthy process for probate dictated by a last will and testament? Or will your assets pass automatically, for example through a living trust? Effective asset management and estate plans cover these concerns.
