Only attorneys are allowed to counsel a homeowner on the Lenders ability to seek payment for a deficiency. A solution may really be no solution at all if a homeowner is at risk of losing their other assets to the bank or getting a large tax bill from the IRS for loan forgiveness.

When a homeowner has more than one option at their disposal, a lender or bank may be less inclined to just ignore a homeowners offer of a short sale or short payoff.

Does it explcitly say they are releasing liability for the remaining loan balance.
4. Is a release of lien or released of mortgage the same as a released from deficiency. (answers no most likely not)
