Areas of Expertise

Real estate attorney vs. Attorney who also practices real estate:  I am a real estate attorney, NOT an attorney that also practices real estate.  During the first five years of my practice I had a general civil practice that involved numerous areas of law with a specialty in real estate that soon dominated these other areas to the point where my practice is 97% real estate and 3% miscellaneous representation that I will undertake as a favor for special clients.  What this means to my clients is that I am in my office working on closings as opposed to in a courtroom with my cell phone off doing something else. What this means to other real estate professionals is that my office is geared for quick, accurate, and smooth closings.   

First Time Home Buyers:  One of the great things about working with first time home buyers is that it gives me the opportunity as a real estate attorney to establish a long term, trusting relationship. Many of my clients return for refinances and basic estate planning work.  I offer discounts for repeat clients and in a typical refinance I save my return clients an average of $300.00 by waiving the title examination and discounting the title insurance.  First time Home Buyers also have many questions.  As indicated earlier, I make myself available to answer any inquiry and review each contract with my clients in person or via telephone at their option at NO CHARGE. . .

Probate and Complex Transactions:  My experience as a general civil attorney exposed me to many areas of the law and I am able to identify and resolve complex estate related title issues.  I have often filed estate work for clients in order to allow them to proceed with a real estate closing. 

Commercial Transactions: As a real estate specialist I have completed many commercial transaction on behalf of my investor clients.  Working with investors and aiding in closing creative financing deals is another area of my real estate practice that I greatly enjoy.

Following is a story that I would like to share on my clients' behalf, with their approval . . . .The A family had gotten themselves into some major debt  - over $100,000.00 in unsecured credit debt.  They had hired a debt consolidation company to help them handle their debt, but all the company had done was amass a war chest of $8,000.00 of the A Family's money and had not contacted or negotiated with a single creditor of the A Family in six months.  Now some of the creditors had filed suit against the A family and they were in far worse financial shape than they had been prior to hiring the debt consolidation company in the first place. My law partner, Jonathan Allen, is a collections attorney and I knew that he knew how to represent debtors as he had seen the successful strategies used by debtors in his creditor collections practice and he knew what worked and what did not work.  Together with the help of a local mortgage broker, Access Financial of West Springfield, Massachusetts (413-788-8400) my law partner and I came up with a plan: we pulled $70,000.00 in equity out of the A family's home and put it in our escrow account.  We then negotiated with the unsecured creditors and averaged a payoff to said creditors of less than 50 cents on the dollar on the entire debt over the course of a year.  We then paid the A family the difference and refinanced their mortgage into a 30 year fixed rate at 6.5%.  On top of all of this we were able to negotiate a settlement with the "debt consolidation company" that the A family had engaged and reclaimed half of their money.  The A family avoided bankruptcy, truly paid off and consolidated their debt and they are much happier today.
