Testimonials
On or about July 24th 2005 Lundh Ltd. received a notice from the Department of Agriculture, that the middle of their new investment was federal property. After about 150 years of apparent private ownership .6 acres was never patented, was owned by the federal government. This small piece bisected the property almost in half. This problem was so serious that if not cured properly, Lundh LTD's investment, the property itself, and over 200 projected jobs could be lost forever.
Lundh Ltd. the project owners, contacted Real Estate America Ltd., who represented Lundh Ltd. in the purchase and the redevelopment of the 5 acre retail project.
Real Estate America learned the federal government stopped issuing patents in 1976 except for rare circumstances approved by congress. The solution was further complicated, as property was located in a special management area in the National Scenic Area and was even scheduled to be sold at a closed bid federal auction.
Considering the risk, Real Estate America Ltd. recommended a color of title patent application as the best course of action. Yes thats right a patent! what? Incredibly, the solution was agreed to by First American Title and the federal agencies involved.
Real Estate America Ltd. gives the credit to and, thanks Pam Campbell with the National Scenic Area, Pam Chappel with the BLM, Senator Wyden’s office.
A spokesperson for Lundh Ltd. was quoted as saying “Real Estate America Ltd.” really understood the problem and their approach was simple; be part of the solution and not part of the problem. They did this without a single lawsuit. This is rare in todays business environment! Real Estate America summed it all up well. “Its all about people and treating them the way you would like to be treated!” We focus on the positive and are now working on remodeling the project with good tenants, creating jobs, and bringing new business to the Columbia Gorge.
