Question: Peter owns 2 adjoining shops, a bakery and a coffee-shop. The bakery fronted the main street while the coffee-shop's behind the bakery. The coffee-shop faces a large car-park and an access road belonging to him is the only way to reach the carpark. On the front outside wall of the bakery there was a sign advertising the coffee-shop.
In 1995, Peter sold the bakery to Bill, but retained the coffee-shop and the car-park.
But now, Bill claims that it's very inconvenient to take deliveries in front of the bakery and that he's entitled to use the car-park both for deliveries and for parking his vans. He has also removed the coffee-shop advertisement from the bakery wall.
So the question is whether Peter owns the dominant tenement or the servient tenement AND... how can both parties be advised on the issues of the car-part and advertisement?
