Following the third unsuccessful attempt by Senate Majority Leader Harry Reid (D-Nevada) who proposed the extension, President Obama is now expected to sign the bill to extend the First Time homebuyers tax credit to September 30, 2010.The bill was previously entangled in a larger jobs bill. Once the tax credit extension was removed from the bill that combined the tax credit with the unemployment benefits extension, the Senate approved the bill as a stand-alone tax credit shortly after the tax credit extension died on the Senate floor.The Senate passed the bill late Wednesday, June 30, 2010. Extension of Tax Credit Deadline failed on the Senate floor. The deadline is today, June 30, 2010. The amendment to extend the home buyer tax credit deadline to September 30, 2010 failed on the Senate floor last week. This resulted in the third unsuccessful attempt by Senate Majority Leader Harry Reid (D-Nevada) who proposed the extension.According to the National Association of Realtors, an estimated 180,000 homebuyers who actually signed purchase contracts within the timeframe will not close by the June 30, 2010 deadline. It is estimated that 75,000 of those homebuyers eligible for the tax credit have purchased distressed properties.It is reported that Republicans were against because it would add $30 billion to the “already staggering national deficit.”Interesting given that the Hous...

If my San Jose short sale clients had more time I would not be chasing down documents from the only offer we have to submit to the lender(s). My clients received a letter from their loan servicer advising that if they do not bring the balance current within 30 days of the date of the letter, the file would be sent to the foreclosure attorney. That means on July 5, 2010 the file will be sent to the foreclosure attorney. If that happens, we may lose our opportunity for a short sale. We must get an offer in and begin the San Jose short sale process. By default, I must start hammering and dogging the buyer's agent to do his job. If I don’t, I am not doing mine. Fannie Mae wants borrowers to act in Good Faith in working out an alternative solution with the servicer. Simply walking away (“Strategic Default”) may subject a borrower to legal action to recoup the outstanding mortgage debt. This means, strategic defaulters may walk away from the property however under Fannie Mae’s new policy, in jurisdictions that allow deficiency judgments, may not simply walk away from the mortgage obligation. In all my years of selling real estate ... I have NEVER "double-ended" a transaction.Why?  Because I have a commitment to the seller first and foremost AND the buyers that have come to me to represent them on my San Jose homes listings actually have done so because they believe they can and will win the deal ... and get a better deal by working with the listing agent. This may or may not be true. It depends on the Listing Agent.I made an exception yesterday ... after spending a total of 6 hours over the course of two days, I wrote an offer for one of my listings. Wow, can you believe that we have a home with a foundation and sub floor and it seems that the city it is located within "regards this as new construction" and with that comment we have to convince HUD that this is a typical rehab project. With a simple comment from a city official all is lost... I hope not. We are clearly within the HUD guideline and why it matters to the city how they classify the construction is beyond me because they are allowing the home to use the existing foundation and sub floor, just rebuild the rest of the home but they insist it is new construction.  Hope to have this resolved shortly.
