Today I read the post from @Gary Woltal "Getting That Earnest Money Back When the Deal Falls Apart". It was a great post and I felt compelled to add to the thought when a transaction falls off -- remember the contract.
I recently experienced a transaction situation that does not fit into the "remember the contract" model. The earnest money was refunded to the buyer and the seller was not happy, but at least he was safe.
A short version of a long story.

Recently I began marketing a home – actually a fee-simple condo – in Northwest Central Austin. The property, while modest in size and updates was balanced with great location, maintenance and amenities. My seller was wise enough to follow my advice to remove all the popcorn, paint, re-carpet and stage. During the final stages of the make-ready for market, I did what most agents do and started pre-mls marketing with a “Coming Soon” sign in the yard and other teasers. The National Association of Realtors is launching a new website with information for homeowners and more tools for Realtors.
The site, called HouseLogic, is intended to help homeowners protect, maintain and enhance the value of their homes, and to provide business-building tools for Realtors. The site will also allow homeowners to speak together with Realtors to federal legislators on public policy issues where homeowners and the real estate industry have a common interest.
