The following is extremely important! HUD has proposed to eliminate seller financing unless the seller lives in the home or becomes a licensed mortgage originator.
How YOU can help:
We real estate investors across the country to go on record with HUD on this issue.  Please review the proposed law and submit your comments to HUD. We have until March 5th (extended due to public response) to flood this system with comments.

With so many loan modification companies advertising their services, it can seem a daunting task to tell the legitimate from the unscrupulous. State and federal officials suggest a few guidelines to help you sort it out:
• If you are asked to notarize loan modification documents for a transaction taking place directly between the actual lender and the borrower, it is likely to be legitimate.
• Check the references of any company offering work that claims to be affiliated with the government or uses a government name as part of its title. The Department of Housing and Urban Development provides a list of government-approved foreclosure avoidance counselors and organizations that do not charge for their services here: http://www.hud.gov/offices/hsg/sfh/hcc/hcs.cfm
• Confirm with the appropriate state agency - often the attorney general's office - that the business is authorized to offer loan modification services in your state.
• Contact your state bar or attorney general's office to verify the credentials of any law firm offering you loan-modification-related work, as some companies fraudulently pose as lawyers or claim to be "lawyer-advised."
• Check a company's rating with the Better Business Bureau to see if there are any complaints about its services.</description>

Firms offering “loan modification” services are appearing across the country —  some offering legitimate help, others merely a front for scams. Steering clear  of crooked companies is a top priority for both Notaries approached to do loan  modification-related work and consumers offered a chance to escape foreclosure —  and state and federal officials are responding.
In November, the FTC announced “Operation Stolen Hope,” a multi-state crackdown  on fraudulent mortgage relief and loan modification schemes in cooperation with  25 state attorneys general. Lawsuits were filed against multiple firms accused  of taking large advance fees from customers without delivering promised services,  making false advertising claims, and otherwise misrepresenting themselves to  customers.
FTC Chairman Jon Leibowitz urged consumers to avoid any loan modification or  mortgage rescue business that asks for a large fee in advance, guarantees stopping  a foreclosure or that urges customers to stop paying their mortgage company.  The NNA also urges Notaries to avoid offers of work from loan modification companies  that ask Notaries to collect large advance fees from customers. The state of California  has banned this practice, and several other states have restricted the collection of  advance fees for loan modifications to attorneys or licensed real estate professionals  only.</description>

      <title>Does new policy of unlimited financial assistance to Fannie Mae, Freddie Mac have tangible negative effects for real estate investors?</title>
      <description>While we were thinking of Christmas and New Years - at a time when most people aren’t paying attention to the news - the Obama administration announced that it would offer unlimited financial resources to Fannie Mae and Freddie Mac.  This money will be used to continue to bail out Fannie’s and Freddie’s current bad loans and enables them to continue to make lending decisions without regard to the safety of their capital.
Furthermore, this unlimited funding enables the federal government to continue to expand its position as the world’s largest mortgage lender.  (Try to find that in the Constitution!)
George Bush began the bailouts in his last year in office, and it was an astoundingly bad idea then.  Since then Barack Obama’s administration has made Bush’s stimulus look like a drop in the bucket.  Obama truly has thrown good money after bad.
Additionally, the Obama administration appears poised to double down on their push for mortgage modifications, with a heavy emphasis on principal reduction.  This will, no doubt, apply to Fannie and Freddie loans also.  Hmmm… unlimited funding for the government lenders plus pressure to forgive portions of the debt being loaned out equals another welfare program in disguise. This program stands in direct contrast to the rules of economics that have stood for thousands of years and will never change.
This is the height of short-term thinking.  Here’s how it plays out:
You pay high tax rates (which will be even higher after Obama’s health care plan becomes law)
Your money is given to Fannie &amp;amp; Freddie who lend it out without direct compensation to you
The Obama administration compensates Fannie &amp;amp; Freddie (and other lenders) to modify mortgages and reduce principal balances, thereby gifting YOUR money to those defaulted borrowers
Of course, the Obama apologists will suggest that it’s the government’s responsible to provide housing to the less fortunate.  But the truth of the matter is that artificially supporting a market always results in damage to that market in the long term, meaning more foreclosures and lower property values.
What do you think?  Is it a good idea for government to artificially prop up the housing market, or will doing so just make the ultimate crash of the real estate market even harder and worse?
Please leave your comments.  This is an important issue for real estate investors because if Obama is wrong - and he certainly is - this action will have the effect of prolonging the real estate crash and driving the United States further into debt with no tangible benefit for the country as a whole.

and some of them have been seeing there vacancies stay vacant longer. We seem to get
rented quick but, these friends have been having trouble. We discussed advertising (which

      <title>The Economic Recovery Plan...</title>
      <description>You know we do not even get amazed anymore at how so many people do not understand what the "bail out" means to our country and it's future! Where will this country get the money to fund the so called bail out? That's right, you stuck your hand in your pocket. That is where the money is coming from.
For the investor who is up on the latest strategies, you will make bank on the deal. Now, do not get this wrong. We do not know where this will all go if this thing is ever even passed, but it is like the old saying goes, "The path to hell was paved with good intentions" so, where this goes, is just as good as a guess as the next guys.
We got an email forwarded to us the other day, we're sure MANY of you got it. It was REALLY an astute observation, even if the math may be off a bit. Take a look see, and please post a response to this second blog (we do not do many) entry, We are SURE looking forward to them all!
WE LOVE COLLABORATING with others on these subjects, it keeps us on our toes.     :O)

Subject: Economic Recovery Plan
I'm against the $85 BILLION bailout of AIG. Instead, I'm in favor of giving $85,000,000,000 to America in a "We Deserve It" dividend. To make the math simple, let's assume there are 200,000,000 bona fide U.S. citizens, aged 18+.
Our population is about 301 million counting every man, woman and child. So, 20 0,000,000 might be a fair stab at adults 18 and up. Now, divide 200 million, 18+ adults into $85 billon - that equals $425,000.00 each!  Yes, my plan is to give that $425,000 to every adult as a "We Deserve It" dividend.
Of course, it would NOT be tax free. So, let's assume a tax rate of 30%. Everyone  would pay $127,500.00 in taxes. That sends $25.5 billion right back to Uncle Sam! It also means that every adult 18+ has $297,500.00 in their pocket. A husband and wife would have $595,000.00!
What would you do with $297,500.00 to $595,000.00?
•        Pay off your mortgage – housing crisis solved
•        Repay=2 0college loans – what a great boost to new grads
•        Put away money for college – it'll really be there
•        Save in a bank – create money to loan to entrepreneurs
•        Buy a new car – create jobs
•        Invest in the market – capital drives growth
•        Pay for your parent's medical insurance – health care improves
•        Enable Deadbeat Dads to come clean – or else
Remember this is for every adult U.S. citizen, 18 and older (including the folks who lost their jobs at Lehmann Brothers and every other company that is cutting back) and of course, for those serving in20our Armed Forces.
If we're going to re-distribute wealth let's really do it!  Instead of trickling out a puny $1,000.00 ("Republican vote buy") economic incentive.
If we're going to do an $85 billion bailout, let's bail out every adult U.S. citizen!!
As for AIG – liquidate it.
Sell off its parts.
•        Let American General go back to being American General.
•        Sell off the real estate.
•        Let the private sector bargain hunters cut it up and clean it up.
We deserve the money and AIG doesn't. Sure it's a crazy idea, but can you imagine the coast-to-coast block party?!
How do you spell Economic Boom ? W-e  D-e-s-e-r-v-e  I-t  d-i-v-i-d-e-n-d! I trust my fellow adult Americans to know how to use the $85 Billion "We Deserve It" dividend more than I do the geniuses at AIG or in Washington, D.C..
And remember, The Birk plan only really costs $59.5 billion because $25.5 billion is returned instantly in taxes to Uncle Sam.
Ahhh...I feel so much better getting that off my chest.
