As some people know, and others do not, Federal Truth in Lending law ("TILA") provides a defense of recoupment where TILA violations are uncovered in a loan file. But just what is recoupment and when is it raised? Several Plaintiffs who have been served with foreclosure papers (notice of default and notice of sale) have sought to file a lawsuit to try to stop the nonjudicial foreclosure sale arguing a TILA recoupment theory.
