      <title>SHORT SALE DERAILED BY SELLER BECAUSE HE WANTS "NO DEFICIENCY"</title>
      <description>I am annoyed!  No more than just annoyed! Dissed and annoyed.  My customer had all of the ramifications of a short sale explained to  him before he agreed to a short sale.  At the end of April, I submitted a  short sale offer to his lender.  Considering the current market, the  offer was huge, only $12,500. less than owed.  How good is that?  My  first short sale had two mortgages, and both lenders lost more than  $50,000.00.  The lender countered with a request that the seller sign a 12 year  mortgage at 0.01% interest for the shortfall.  I called my customer and  explained the counter.  He almost blew a gasket.  He said to tell them  to "just foreclose".  I explained that the offer should be countered and  that at its worst it was better than a foreclosure, because the bank  would take an even bigger loss, his deficit would increase, and the bank  could still come after him for a deficit judgement and that would be at  about 11% interest.    My customer was adamant, so now I'm sitting here having a little rant.  Having just told the bank what my customer told me to tell them, I feel a  huge loss for my customer, who acts as if the grey stuff between his  ears is leather.  Foreclose over $12,500?  You have to be kidding I  wanted to say.  Foreclose,  and take a bigger and more expensive hit  from the bank?  You have to be stupid!!!! I wanted to say.  But I gently  agreed to my customers terms even THOUGH HE IS WRONG! WRONG! WRONG!    And never will be RIGHT with his mind-set.    But... on the other hand, I should have prepared him better, and it is  HIS LIFE, not mine.

      <title>Postlets is Great, I mean Really Great.  AND I NEED HELP WITH SCRIBEFIRE which AR Recommended</title>
      <description>I just bought into a couple of zip codes on Zillow to pump some more traffic into my pipeline.  The sales person, let's just call him Joe told me that all I had to do to get my listings onto Zillow was to ADD A LISTING by entering THE ADDRESS, and everything else would be taken care of.
Well I tried that, and what resulted was (with my further input) a line or two, listing the address of the property and the price with my "abbreviated" features.
I took an immediated dislike to Joe, and searched around for a way to quickly syndicate to Zillow from some platform that was "free".
You guessed it.  www.postlets.com came to the top of the list.
In less than 15 minutes I had created a free postlets account, Created a listing: syndiacted it to
Google Base, Oodle, HotPads, Trulia, DotHomes, Zillow, Backpage, Vast, Enormo, and others.

and it is quite impressive.  How much did it cost?  NADA!  and it saved me a ton of time.

I installed ScribeFire to assist me, and now my HTML editor in Active Rain No longer works.
I cannot figure out how to set up Scribe Fire to blog to my active rain blog either.

The distance between the president and the people is beginning to be revealed.

The deepening notes of disenchantment with Barack Obama now issuing from commentators across the political spectrum were predictable. So, too, were the charges from some of the president's earliest enthusiasts about his failure to reflect a powerful sense of urgency about the oil spill.
There should have been nothing puzzling about his response to anyone who has paid even modest critical attention to Mr. Obama's pronouncements. For it was clear from the first that this president-single-minded, ever-visible, confident in his program for a reformed America saved from darkness by his arrival-was wanting in certain qualities citizens have until now taken for granted in their presidents. Namely, a tone and presence that said: This is the Americans' leader, a man of them, for them, the nation's voice and champion. Mr. Obama wasn't lacking in concern about the oil spill. What he lacked was that voice-and for good reason.
Those qualities to be expected in a president were never about rhetoric; Mr. Obama had proved himself a dab hand at that on the campaign trail. They were a matter of identification with the nation and to all that binds its people together in pride and allegiance. These are feelings held deep in American hearts, unvoiced mostly, but unmistakably there and not only on the Fourth of July.
A great part of America now understands that this president's sense of identification lies elsewhere, and is in profound ways unlike theirs. He is hard put to sound convincingly like the leader of the nation, because he is, at heart and by instinct, the voice mainly of his ideological class. He is the alien in the White House, a matter having nothing to do with delusions about his birthplace cherished by the demented fringe.
One of his first reforms was to rid the White House of the bust of Winston Churchill-a gift from Tony Blair-by packing it back off to 10 Downing Street. A cloudlet of mystery has surrounded the subject ever since, but the central fact stands clear. The new administration had apparently found no place in our national house of many rooms for the British leader who lives on so vividly in the American mind. Churchill, face of our shared wartime struggle, dauntless rallier of his nation who continues, so remarkably, to speak to ours. For a president to whom such associations are alien, ridding the White House of Churchill would, of course, have raised no second thoughts.
Far greater strangeness has since flowed steadily from Washington. The president's appointees, transmitters of policy, go forth with singular passion week after week, delivering the latest inversion of reality. Their work is not easy, focused as it is on a current prime preoccupation of this White House-that is, finding ways to avoid any public mention of the indisputable Islamist identity of the enemy at war with us. No small trick that, but their efforts go forward in public spectacles matchless in their absurdity-unnerving in what they confirm about our current guardians of law and national security.
Consider the hapless Eric Holder, America's attorney general, confronting the question put to him by Rep. Lamar Smith (R., Texas) of the House Judiciary Committee on May 13.
Did Mr. Holder think that in the last three terrorist attempts on this soil, one of them successful (Maj. Nidal Hasan's murder of 13 soldiers at Fort Hood, preceded by his shout of "Allahu Akbar!"), that radical Islam might have played any role at all? Mr. Holder seemed puzzled by the question. "People have different reasons" he finally answered-a response he repeated three times. He didn't want "to say anything negative about any religion."
And who can forget the exhortations on jihad by John Brennan, Mr. Obama's chief adviser on counterterrorism? Mr. Brennan has in the past charged that Americans lack sensitivity to the Muslim world, and that we have particularly failed to credit its peace-loving disposition. In a May 26 speech at the Center for Strategic and International Studies, Mr. Brennan held forth fervently, if not quite comprehensibly, on who our enemy was not: "Our enemy is not terrorism because terrorism is just a tactic. Our enemy is not terror because terror is a state of mind, and as Americans we refuse to live in fear."
He went on to announce, sternly, that we do not refer to our enemies as Islamists or jihadists because jihad is a holy struggle, a legitimate tenet of Islam. How then might we be permitted to describe our enemies? One hint comes from another of Mr. Brennan's pronouncements in that speech: That "violent extremists are victims of political, economic and social forces."
Yes, that would work. Consider the news bulletins we could have read: "Police have arrested Faisal Shahzad, victim of political, economic and social forces living in Connecticut, for efforts to set off a car bomb explosion in Times Square." Plotters in Afghanistan and Yemen, preparing for their next attempt at mass murder in America, could only have listened in wonderment. They must have marveled in particular on learning that this was the chief counterterrorism adviser to the president of the United States.

Long after Mr. Obama leaves office, it will be this parade of explicators, laboring mightily to sell each new piece of official reality revisionism-Janet Napolitano and her immortal "man-caused disasters'' among them-that will stand most memorably as the face of this administration.
It is a White House that has focused consistently on the sensitivities of the world community-as it is euphemistically known-a body of which the president of the United States frequently appears to view himself as a representative at large.
It is what has caused this president and his counterterrorist brain trust to deem it acceptable to insult Americans with nonsensical evasions concerning the enemy we face. It is this focus that caused Mr. Holder to insist on holding the trial of Khalid Sheikh Mohammed in lower Manhattan, despite the rage this decision induced in New Yorkers, and later to insist if not there, then elsewhere in New York. This was all to be a dazzling exhibition for that world community-proof of Mr. Obama's moral reclamation program and that America had been delivered from the darkness of the Bush years.
It was why this administration tapped officials like Michael Posner, assistant secretary of state for Democracy, Human Rights, and Labor. Among his better known contributions to political discourse was a 2005 address in which he compared the treatment of Muslim-Americans in the United States after 9/11 with the plight of the Japanese-Americans interned in camps after Pearl Harbor. During a human-rights conference held in China this May, Mr. Posner cited the new Arizona immigration law by way of assuring the Chinese, those exemplary guardians of freedom, that the United States too had its problems with discrimination.
So there we were: America and China, in the same boat on human rights, two buddies struggling for reform. For this view of reality, which brought withering criticism in Congress and calls for his resignation, Mr. Posner has been roundly embraced in the State Department as a superbly effective representative.
It is no surprise that Mr. Posner-like numerous of his kind-has found a natural home in this administration. His is a sensibility and political disposition with which Mr. Obama is at home. The beliefs and attitudes that this president has internalized are to be found everywhere-in the salons of the left the world over-and, above all, in the academic establishment, stuffed with tenured radicals and their political progeny. The places where it is held as revealed truth that the United States is now, and has been throughout its history, the chief engine of injustice and oppression in the world.
They are attitudes to be found everywhere, but never before in a president of the United States. Mr. Obama may not hold all, or the more extreme, of these views. But there can be no doubt by now of the influences that have shaped him. They account for his grand apology tour through the capitals of Europe and to the Muslim world, during which he decried America's moral failures-her arrogance, insensitivity. They were the words of a man to whom reasons for American guilt came naturally. Americans were shocked by this behavior in their newly elected president. But he was telling them something from those lecterns in foreign lands-something about his distant relation to the country he was about to lead.
The truth about that distance is now sinking in, which is all to the good. A country governed by leaders too principled to speak the name of its mortal enemy needs every infusion of reality it can get.

Who Can Buy a HUD Home?

      <description>Just an hour and half ago, I had the distinct pleasure and privilage to stand on the banks of the Indian River in Titusville Florida and watch the space shuttle Atlantis rise over the new bridge being constructed to carry traffic to the Merritt Island National Wildlife Refuge and the North Entry to Kennedy Space Center.  As I watched with my Children and Grandchildren

      <title>WHY DO FRIENDS NOT HAVE EARS TO HEAR YOU, BUT HEAR OTHER LO'S LOUD AND CLEAR</title>
      <description>Lets call my seller Elmer for privacy.  We listed his property six months ago in a very declining market .  It has declined even more each month, with no end in sight.
The property was listed for SALE and for RENT with the owner willing to do either, but only at prices the market would not support
Lets look at the rent side first.  We asked a Lease Price about $100.00 per month above comps (owner chose the point over explanation that the price was too high).  We got few showings, and with those few, the prospective tennants would not make offers even when they were told the owner would negotiate.  No offers because the prospects perception was that the price was so high a reasnable lease could not be negotiated.   Every time we told the owner they needed to reduce the asking price the answer was the same - "we will negotiate".  Even when the fact that tenants would not even look at the property unless it was priced correctly, the answer was the same.
The selling price was $20K more than an identical unit just up the street was listed at, and $10K more than another close by unit, also identical.  My seller had to cover his mortgage and his costs, so he insisted.  We tried to convince the owner that he could come to closing with money or do a dubious shortsale (this was no longer his primary residence).  He said he would never do a short sale and would not come to closing with money.  STALEMATE with a friend.
And so, you guessed it.  The listing expired (my bad), and suddenly my seller could hear!
The listing is now at $99K, $20K short of the money, and is listed as a short sale by a Realtor who has never handled a short sale in her life.  Not that the first one can't be successful, but on an investment property, by a seller who cannot concievably show a hardship?  Oh, my friend is hearing all right.
When I saw that and called to ask about the listing, he stated that all along all he wanted was advice on how to sell the property.  What was wrong with Elmer's ears?
Friends cannot hear friends, even experienced Real Estate agents, but they can hear others who say the same thing!
My venting is done now.  Thanks for listening.

      <description>What a day!
On the last day of the Tax Credit (for those of us who do not back date contracts... oh, that's ALL of us, right?)  I wrote my own world record number of "sides"   Eight for the day.  FInished up at 9:45 PM with a buyer who called at 5:45 to vent about HIS realtor, who told him at 5:15 is was too late to get the credit.
Oh, thank you ex-realtor for my buyer.  I straightened out his thinking and closed the deal Friday evening.
My belief is that if I don't work for a buyer or seller and give it my utmost, someone else will.

      <title>Mortgage Difficulty Homeowner Options</title>
      <description>Everyone knows someone who is having or anticipates having difficulty making or keeping up with Mortgage payments.  This Sunday, March 14th, from 2-4PM, my husband Jay will be making a presentation followed by questions and answers describing the Foreclosure timeline, Short- Sales, Deed In Lieu, and other Distressed Homeowner options.
The problem is not localized, nor is it the homeowners fault in most cases.  Some of the reasons for distress and difficulty are:

      <title>What was my seller thinking?</title>
      <description>Anyone have this experience with a Short Sale?
My seller had originally lived in this home as Primary residence.
During the Crazy market, he decided to purchase a country home, and did so, thinking he could easily sell his "old" primary residence and have only one property.  Well - you guessed it.  The crazy times ended and he "chases" the market down until finally in desperation, leased the home to a deadbeat.  After eight months, and plenty of damage, he evicted the tenant.
The banks were hounding him because he could not make both mortgage payments, so he hired a "law firm outside the state" to deal with the now "distressed property".  Paid them $2,500.00 up front to do what we realtors do for free - deal with the bank for him.
Now after four months of that, he came to me to list the property for short sale.  Well, OK, stop fooling around with the "law firm" and lets get this done, I thought (foolishly).
When our first offer came in it was reasonable for the property condition and th market.  Unfortunately, the seller had a REALTOR friend in Arizona who advised him to counter the offer.  He did, at an unreasonable level.  No amount of persuasive talk, details, and statistics would sway him, so the buyer walked.  The bank never saw the offer.  The seller actually struck whole paragraphs from the as-is contract (seller pays: requested seller concessions, etc.).  I asked him why he did that, and he said he wanted to limit his deficiency!  I explained in detail that as time went by, and it surely would go by based on his counter offer, his deficiency would surely go higher and higher.  He had a friend in Arizona, a Realtor, remember...That Realtor should lose his license for giving rediculous advice.
So, Thursday I drive by the property and find my $100.00 Electronic Lockbox gone and a combo in its place.  I talk to the neighbor who says that the bank foreclosed on the property January 15th!. I guess its my bad for not checking on the property more often, but so many calls to the seller were unanswered and unreturned that I just did not want to deal with it. I guess the seller didn't either, and the bank or the banks property preservation company has my lockbox#$&amp;amp;*@Jean C Kelly, GRI</description>

      <title>Sales Up again in Florida - Statistics are positive but is the bottom line up as well?</title>
      <description>The Florida Assoc Of Realtors has confirmed my experience that sales volume, as determined by housing units sold, continued to rise in December.  According to FAR, that's 17 consecutive months of rising unit sales.  But that is not the whole story.... unfortunately.
I'm killiing myself!  For my record last year was 32 "sides". far more than 2008, and income was up as well, but nowhere near the percentage that "sides" were up.  So, while "sales" continue to rise, bank balances are at a historical low.  Boo-hoo.
Am I looking forward to another great year?  Well yes, but looking at the headlines in Saturdays Florida Today newspaper here on the "Space Coast" of the world, I'm depressed.  Our president, who came to Florida and, seeking election, roundly supported the space program, has done the unthinkable - cut out funding for all space vehicles in development for NASA.  The result is predictable, and FL Today made the research official (Source: Brevard Workforce President Lisa Rice) - 23,000 Direct and indirect job losses in Brevard County Florida.  THAT IS CATASTROPHIC! We already have more than 10% of our people unemployed.  Another three years of this "leadership" who wants to reach out to the Muslim world and offer space technology to them?  A subject for another time, it could become a rant.
Does anyone know where the market is "hot" and expected to stay that way for a couple of years?

      <title>Writing offers on REO's</title>
      <description>We should always caution our buyers to make REO offers reasonable in order to maximize the buyers chance of success.  To this end, we suggest several points to our buyers:
1) The property manager for the REO is only motivated by his/her monthly goals.  There are no emotions.
2. Make offer based on MY BPO.
3. Have pre-approval or proof of funds for cash offers
4. Ask for a quick closing date
5. The offer is "as-is", no repairs, so make sure you do a thorough inspection personally or professionally.
6. Do not make the offer contingent on selling an owned property.
7. Buying "as-is" does not eliminate the right to inspect and withdraw.
8. BUYING A REO THAT NEEDS WORK, IF THE PROPERTY WILL APPRAISE, THE LOAN CAN BE A CONSTRUCTION LOAN TO DO THE WORK REQUIRED.Jean C Kelly, GRI</description>

      <title>Better results on Short Sales are just a few responsible steps away</title>
      <description>THis post is primarily for the agents who are listing a property for Short Sale.
My better half  Jay (or Jency if you prefer) is a Certified Distressed Property Expert, and has has also completed the "coveted" FAR approved class "Short Sales and Foreclosures, What Buyers Reps Need to Know".  His take on the training available to Realtors: Get your CDPE training and stop wasting money on other SS training.
First Point:
Begin with the idea that you are going to create a paper trail that says to the bank "Look, I tried to get you better offers, and no one was interested".  You accomplish this by initially pricing the property at or slightly above your best-effort BPO.  When you write the listing agreement write an addendum that allows you to lower the price periodically to specified levels on specific dates (the last Friday of the Month, or something like that).  Exception:  If the foreclosure date is set, and time is short, start low.
Second: Get approved by the bank to talk to them and begin talking immediately.  Be so nice that sugar will not melt in your mouth.  You are dealing with poorly paid, overworked, often insulted employees that are under immense pressure.  Yours will be one of 60 files on their desk, so...
Third: the bank expects, in fact demands, a professionally prepared package.  Put a cover letter on your SS package when you send it in.  Have a list of the repairs the place needs (helps justify the short sale).  Number the pages 1 of x, 2 of x, etc, have the loan number, property address and your contact information on all pages.  Put a blank page at the end and label it in your handwriting: Last page.  If you do this step well, they MAY not lose your file but one or two times.  Guaranteed it will go to the top of the stack.  SUBMIT TO ALL MORTGAGE HOLDERS SIMULTANEOUSLY - FIRST, SECOND, THIRD.
While this list is not nearly exhaustive as I can make it, you will be setting up the bank's recognition of your abilities.  That includes the ability to negotiate on the deficiency, which can be negotiated away for your seller.  We are, in truth, the only party to the contract that shouldn't have a strong bias either way.  With that and a little knowledge, we can ask for language that eliminates the possibility of a deficiency judgement and if we are REALLY good, has the mortgage payoff reported to the credit bureau as paid in full.
One parting comment:
The only Distressed Property owner I have little sympathy for is the one who used their property just like a checkbook.  Sellers who treated a HELOC or other mortgage product as if it were earned income should have seen it coming.  They earned their punishment, and at best a deficiency judgement is well deserved.Jean C Kelly, GRI</description>
