“Reasonable Care” now appears to be the requirement in MA.
Massachusetts property owners have a what lawyers call "a duty" or responsibility to use “reasonable care” for the protection of visitors. That would appear to make homeowners responsible for the removal of snow and ice from their property. That means for visitors, delivery people, family, friends, etc., need to be able to access and passages after the owner has used "reasonable care" to clear them.

Here is some housing market data for Falmouth MA. It shows that there have been twice as many properties coming on the market as have been sold. And the current inventory is almost 1 year. This chart is for Non-Waterfront properties only. While Falmouth has more waterfront that any other town in the country, there are many more homes in Falmouth that are not on the water.

The average list to sale price shows 95%. The only problem I have with that nymber/percentage is that is relative to the listing price at the time it went under agreement. This does not take … (3 comments)

I just received a call from the Falmouth fire department informing me that smoke detector inspections in the town of Falmouth MA cannot be scheduled until after June 16 because all the slots are full. On the one had this is good news, because that means that there are lots of closing happening! On the other hand it means that offers have to carefully written.

It must be insurance month.  The other day I posted about a new insurance product specifically for open houses.  Today I see one about lock boxes.  Although I agree that placing a listing on a lock box has some risks, I haven't seen an insurance offering for listings on a lock box before.  I don't use lock boxes, so I am not so worried about the insurance.  But, having a few listings on lock boxes listed by other companies can make showing homes a little easier.

Many customers aren't aware, but there are 2 Multiple Listing Services (MLS) on Cape Cod for Cape Cod real estate.  One is the traditional one that has been here since the pilgrims started selling houses between each other, and the other is from "Off-Cape" and is working hard to "annex" the Cape into its massive database.  My company has been a member of both for the last ten years, but many companies on the Cape are members of only the Cape Cod and Islands MLS and not the Property Information Network (PIN).

It seems logical that the word function derives from Feng Shui.  This current business of "feng shui-ing" your villa in order to sell seems as useful as burying Joseph upside down in the front yard.  In Webster's dictionary, one definition of functional is "designed or developed chiefly from the point of view of use."  In other cultures they may have feng shui-ists.  Here in the US we use architects to design functional real estate.  In economics we have - well we have dis-functional opinions and equations that all use differing variables to try and explain the same im-measureable thing.

Chatham is in the Lower-Cape area of Cape Cod.  It is bounded by Harwich and Orleans.  Half of the properties in Chatham are second homes (50%+-).  Chatham has beaches on both Nantucket Sound and on The Atlantic Ocean.  Even with its high second home percentage, Chatham has very few of its homes in pre-foreclosure as of May 6, 2008 which is probably because Chatham has traditionally been a place of upperclass incomes and "older money" families' second homes.

Dennis, Massachusetts is a typical Cape Cod town.  There are areas that are designated by the locals like Dennisport, East Dennis, West Dennis, South Dennis, and just plain Dennis.  Of course, just like Route 6 that runs east and west but is called North 28 and South 28, Dennis has some geographic name abnormalities.  West Dennis is south of South Dennis.  Dennisport is east of West Dennis but is not actually part of East Dennis.  And there is actually more of a port in East Dennis at the Yacht Club (the Dennis Yacht Club) than there is in Dennisport.  The Dennis … (1 comments)

On May 6, 2008, I did some research on pre-foreclosures in Cape Cod towns.  Only 1.3% of the 140,000(+-) homes on the Cape were at the stage of pre-foreclosure.   Less than half of the homes on Cape Cod are actually second homes, and commercial properties are not included in the 1900.  Most homes on the cape are owner occupied, contrary to popular opinion. Some areas within Cape Cod towns do have more than 50% vacation home or investment status, but for the most part, the Cape has a year-round economy.
