As we look forward to a new year we are reminded that the new Consumer Disclosures will become mandatory in August.
Those of us in the title industry have already started gearing up for the changes by updating our computer hardware if needed so that our computers are able to handle the new software, attending training and working with our software providers and our IT providers  to ensure that our updates will be ready for install in time for the August 1 deadline.

When a buyer or seller is presented with a standard contract of sale that contract can now far exceed more than 40 pages.  Among those pages is often found a page titled "Affiliated Business Arrangement Disclosure Statement"

 I know this bill has been floating along for a while now and I have meant to comment on it.  I generally agree with this proposal and hope that it sees passage
H.R. 4229-Borrowers' Right to Inspect Closing Documents Act of 2009.  
This bill was introduced in the house in December 2009 and has been assigned to the Committee on Financial Services.   The focus of this bill is to enable the borrowers to review their entire closing package three days prior to closing.  The bill would make it the responsibility of the lender to provide the closing package to the title agent no less … (2 comments)

HUD announced on June 4, 2010 that it will solicit information that can be used to inform any future revision or clarification of the regulatory definition in the "required use" of affiliated settlement service providers in residential mortgage transactions.

I took a call from a local auctioneer and investor today
 
He called to see if we were interested in acquiring new business.  Well what small independent title agent is not interested in acquiring new business? 
His first question to me was "do you have the forms necessary to form an ABA?" I responded that we did not and that I was not interested in forming an ABA. He then took on quite an attitude with me!
