One of several Texas state constitutional amendments coming up for a vote on November 3rd involves Eminent Domain Restrictions. This amendment would restrict the state's ability to take private property for public use unless it is for a specific use or purpose. It also excludes eminent domain authority when it is considered for the purposes of economic development or increasing tax revenue. People in favor of the amendment say it will enhance state law and and clarify it for the courts that rule on eminent domain. Being a native Texas it would be fair to say that I might be just a Little biased towards the place I call home.
