Many real estate investors contractually arrange to be able to immediately list the property for sale (at a higher price). Legally, there is no problem with this (if done correctly). For example, I recommend stating that the seller is a "contract buyer".  This removes the property from the stigma of being a short sale since the contract buyer is paying cash and re-selling as the "B" buyer in an A to B to C transaction.

As reported by the Los Angeles Times, and others,  those servicers involved in the robo-signing settlement may now be forced to permit modifications, principle reduction settlements, and short sales. While the terms of this proposed settlement are still being negotiated, the impact of the settlement could have some positive effects for both short sale sellers and purchasers of short sales. Actually, I did want to complete the original thought...here is a true "Where there is a will, there is a way story". In speaking with an agent from Florida tonight..he relayed the story of a client invetor that offered $500,000 on a commercial short sale. The smaller regional bank countered at $1.8 M - a seemingly insurmountable spread, especially when the bank indocated that it cannot take less due to banking regs. Knowing banking law very well, I realized that this means that this one loan could sink the bank.
