lehigh valley: Cramdown One More Tool in Obama's Housing Toolkit - 04/02/09 11:20 PM

President Obama's housing rescue plan includes a cramdown provision that would allow bankruptcy-court judges to write down mortgage debt for homeowners. This bill will only apply to existing mortgages on primary residences, and homeowners would only be eligible if they can prove that they made an effort to work a deal with their lender prior to filing for Chapter 13 bankruptcy. Current legislation allows bankruptcy-court judges to reduce all debt, except mortgages on primary residences.

The foreclosure problem is so immense that neither government nor private lenders has yet come up with an all encompassing solution. Both entities, however, are trying to find ways that help homeowners while preventing further losses from foreclosures.
Early responses to the government-led Hope for Homeowners program have been discouraging. What was hoped to be a way out for 400,000 trouble homeowners may now only attract 20,000 borrowers, according to Department of Housing and Urban Development spokesman Steve O'Halloran. The real estate market in neighboring state Ohio was shaken up in early November when Pittsburgh-based Howard Hanna Realty bought its top Northeast Ohio competitor Realty One. Until recently, both firms had about a 15% share of the local market, but amidst the recent turmoil in the housing market, Howard Hanna pulled ahead with a 22% lead. The increase for Howard Hanna came from the market share of competitors, as Realty One still had about 15% of the market at the time of the sale.

Housing starts, nationwide, are the lowest in 50 years at 817,000. One of the nation's largest builders, Toll Brothers, finds its revenue off 41% as customers cancelled orders. But why build at all when there is a 10 month inventory of homes available? MSN Money recently cited three reasons:
