offer: Is It A Binding Contract?

I use the approved Massachusetts Association of Realtors Contract to Purchase, Form 501, for my offer form. Contained in that form are 2 checkboxes. One is checked if you are attaching a "Good Faith" check and the other checkbox says A Good Faith check will be provided when the offer is accepted. Many folks already have the check and simply make a facsimile copy of the check. Once the offer is accepted then the real check is placed into the hands of the Realtor whose company is providing escrow.
