exclusive: Types of Real Estate Agents and the Best Agent for Buyers - 10/15/13 09:03 AM
Different Types of Real Estate Agents
Listing or Seller's Agent:  These agents are the "traditional" type of real estate agent. A listing agent works on behalf of the seller and represents them, looking out for their best interest in the transaction.
Buyer's Agent:  A "Buyer's Agent" is usually a traditional agent who is working for a buyer in a transaction. The "buyer's agent" may also work for sellers in other transactions as their listing or seller's agent.
Dual-Agent or Limited Agent:  An agent who works for both the buyer and the seller in the same transaction in the capacity of a … (2 comments)

exclusive: Exclusive Buyer Agency In the News - 09/04/13 08:02 AM
I came across an old article in Kiplinger's Personal Finance touting the benefits of hiring an Exclusive Buyer's Agent (E.B.A. for short). The point of the article (and it's title) was: Hire your own AGENT
Buyers and sellers, have different interests in a real estate transaction. Sure, one wants to sell and the other buy, but both want to get the best deal. Independent representation makes sense. Two competing sports teams both want to play the game, but both want to win. They both have independent coaches to help them achieve their goals. So it should be with real estate.
Exclusive Buyers Agents work only for … (1 comments)

exclusive: Two Buyers, One House... One Agent? - 10/09/12 10:15 AM
Let's talk about agency, representation, and conflicts of interest.
We received a call today from a gentleman who had just fired an agent he had been working with for a few months. We'll call him Bob.
Bob and his agent were out together looking at a HUD home when a man "off the street" came to the door and asked to see the home. Bob's agent let the prospect in to tour the home and spent time with the man, giving him her card as he left. Later, when Bob expressed a desire to write an offer on the home, his agent informed him … (5 comments)

exclusive: Agency Disclosure - The Fleecing of Real Estate Consumers Continues - 03/15/12 07:33 AM
I've been following the efforts of a colleague in Maryland who believes exclusive buyer representation should be disclosed to consumers as an option on the state's agency disclosure form.
I read an article on the topic in the real estate section of the online Baltimore Sun. The Director of Regulatory Affairs for the Maryland Association of Realtors, Mark Feinroth, stated that the suggested changes would cause "a big change in agency law that's really unwarranted."
Agency -- who's representing whom -- "is already the most difficult concept to train licensees in, and it's a very difficult concept to explain to consumers," Feinroth said. "I think this will make … (8 comments)

exclusive: The Highest Level of Representation for Buyers - 11/03/11 09:40 AM
My last blog entry was a testimonial from me about my new dentist. What does that have to do with buying a home? Lots.
Everybody should know about biomimetic dentistry and doctors like Dr. Noot. I really connected with him and his practice because:
1. He really cares about what is best for his patients.
2. He takes the time to educate his patients about what is going on.
3. He lets the patient make the important decisions regarding their care.
4. He has gone the extra mile in his personal training and education in order to provide his patients with … (0 comments)

exclusive: "We Wanted to Make Sure We Had an Agent We Could Rely On" - 10/25/11 01:26 PM
Prior to working with an EBA, we had been involved in four other real estate purchases and three sales and had developed some skepticism toward realtors in general.  This most recent move was our first that wasn’t just to another part of town.  This time, we were to move ourselves, our five kids, our dogs and our cats 300 miles.  We wanted to make sure we had an agent we could rely on.  We shopped extensively and even spoke to a few agents before we found Homebuyer Representation on the web.
We felt good about working with our EBA from the … (0 comments)

exclusive: Research Scientists Share Benefits of Hiring an Exclusive Buyer's Agent when Buying a Home - 10/18/11 07:01 PM
Our Exclusive Buyers Agent (EBA) was a pleasure to work with because of his laid back, no-pressure approach. His only motivation was to help us find the right house for us, not to sell a home.  He never pressured us to consider a home we were not interested in. Rather, he suggested we see many homes so we could figure out what we actually wanted, and what we did not want. When we had a disagreement on which house we liked better, he made sure to let us come to our own conclusion. We are very happy with how it turned out, and … (1 comments)

exclusive: Military Buyer Chooses an Exclusive Buyer Agent (EBA) with Great Results! - 10/03/11 01:28 PM
I’ve done extensive research in home buying over the past few years.  I knew the only way to go was an EBA (Exclusive Buyer’s Agent), but I didn't know of any in Utah.
Fortunately, a random internet search brought up Benjamin Clark with Homebuyer Representation.  I called him, and then met him in person.   He was easy to work with and has extensive knowledge of the home buying process.  He was always willing to take time to answer my questions and explain anything I didn’t understand.
I was purchasing a second home and Ben kept me on the right track … (0 comments)

exclusive: Representation - You Get What You Pay For - 09/30/11 10:09 AM
At Homebuyer Representation we put our clients first. Our clients are always Buyers, all the time.
We do not represent Sellers ever. We don't "switch teams" in the middle of the transaction. Our focus is on what is best for the Buyer. We don't work to get the deal to go through if the client doesn't want it to go through or if it isn't in the Buyer's best interest for the transaction to close. We have no specific properties we need to "move" or "sell". We can help a Buyer purchase any property listed by any real estate brokerage, home-builder … (2 comments)

exclusive: Salt Lake City "Super" Accredited Buyer Representative - 09/30/11 08:10 AM
Well, I did it again! I decided to get the ABR designation for the second time. Yes, this means I took the entire curriculum over again, so you could say I'm twice as knowledgeable as those who have only earned the Accredited Buyer Representative designation once!
Okay, so maybe I didn't learn twice as much, but taking it from different instructors each time and a few years apart, I do have to say the course was a great reminder of how to property serve the real estate buyer and gave me some ideas on how I can make my buyer representation … (0 comments)

exclusive: What's worse than a lowball offer? - 05/26/11 07:26 AM
Throughout history, and still today, a big fuss is made over ridiculous "low-ball" offers from Buyers. What's the big deal? Reject them. If your price is right, a buyer will appear. If you keep getting buyers, who appear unreasonable, perhaps you should reconsider who's being ridiculous.
A low-ball offer (or an overpriced listing) requires very little research because the agent doesn't have to narrow down a market value to prepare what is obviously, to everyone involved, an unreasonable offer (or value). How will that help you in the next stages of negotiations (if you get that far)? It won't. It will … (5 comments)

exclusive: FHA MIP on the Rise - FHA Loans Becoming Less Attractive, Costing More - 02/16/11 08:05 AM
FHA Annual Mortgage Insurance Premium just went up another .25%
On a $300,000 loan, this means the monthly payment just went up $62.50 per month!
This goes into effect on loans insured by FHA on or after April 18, 2011.
I hope our new construction buyers with FHA loans have homes to close on before then!
There is surprisingly little coverage on this. Here is one of the few links I could find other than bloggers: Fox News
If you will be buying a home with FHA Financing this spring ANYWAY, you may want to consider beginning your home search a … (3 comments)

exclusive: Avenues Homebuyers Find Working with Exclusive Buyer's Agent "Extremely Rewarding Experience" - 04/13/10 05:28 AM
We relocated from California at the end of last summer, and having sold our home there, we were excited to begin looking for a new one in the Sugarhouse area.  Initially, we were using a listing agent that was set up for us by the relocation company.
When it became clear that this arrangement wasn’t working out, we decided to find an agent that was more attentive to our needs and interests.
Our Exclusive Buyers Agent has been excellent at every stage of helping us to acquire our new home.  We had absolutely no pressure to look in particular areas, … (0 comments)

exclusive: Salt Lake City Home Buyer - Exclusive Buyers Agent Was "Wholly Dedicated to My Cause" - 04/06/10 05:37 PM
Benjamin Clark of Homebuyer Representation, Inc. in Salt Lake City, Utah, helped me find and buy my home. He was an excellent agent in all ways and I recommend him wholeheartedly to any potential home buyer.
Because he is an Exclusive Buyer's Agent, Ben was wholly dedicated to my cause throughout what turned out to be a 4-1/2 month long process.
He was enormously helpful, dedicated, persistent, knowledgeable, proactive, and consistently agreeable and pleasant.
His negotiating skills are impressive.
He makes great efforts to stay current in his field.
I enjoyed our association and greatly appreciate his work … (3 comments)

exclusive: U.S. President Barack Obama Recommends Home Buyers Hire Their Own Agent - 04/01/10 11:43 AM
U.S. President Barack Obama met Thursday with the President of the National Association of Exclusive Buyer Agents to express his support for the efforts of the consumer friendly non-profit association which educates consumers about their right to equal representation in the real estate transaction.
The President just recently became aware of Exclusive Buyer Agency at a joint meeting of the U.S. Department of Housing and Urban Development and the Consumer Financial Protection Agency. He was intrigued by a section within HUD's new guidebook, which details ways in which consumers can protect themselves when buying a home and obtaining a mortgage loan.

Exclusive Buyer Agents:
Do not list homes or represent sellers Work for real estate companies that take no listings Work solely for the buyer Remain loyal to the homebuyer throughout the transaction Avoid conflicts of interest inherent in the traditional seller-oriented purchase transaction Never represent the seller in a real estate transaction Are less than 1/2 of 1% of all real estate firms nationwide Offer a unique relationship of trust to real estate buyers Offer a higher degree of loyalty to a buyer than an agent who also works on behalf of the Seller Do not practice dual-agency Are 100% loyal … (2 comments)

exclusive: An Equal Level of Representation for Home Buyers - 03/16/09 04:14 PM
Great Article in the New York Times Friday, featuring a good friend and colleague of mine, Ira Freireich of Long Island, NY.
The article points out how many homebuyers are becoming more savvy and aware of how they can get the best level of representation in the real estate transaction: Exclusive Buyer Agency.
Some key points:
Exclusive Buyer Agents (EBAs) negotiate for the Buyer EBAs work for the Buyer only - Not the Seller like traditional real estate agents EBAs keep confidential information confidential - The seller won't know that you can or will pay more EBAs give you more control … (3 comments)

exclusive: Dual Agency, Bad for Buyers (And Sellers!) - 03/16/09 03:36 PM
When I first began my career in Real Estate, I observed agents as they asked consumers to agree to dual agency. Sellers are often asked to do so when they list the home. Buyers are often asked to do so when writing an offer. When taking a listing they may have said something like:
Initialing here allows me to bring a Buyer for your home.
When writing a contract with a Buyer, they may have said something like:
Initialing here allows me to help you with the paperwork to buy this home.
No discussion whatsoever about what fiduciary duties a Seller or … (1 comments)

exclusive: Home Buyers in Sandy, Utah Value Having an Agent on Their Side - 03/12/09 01:29 PM
We recently purchased our first home in the Salt Lake area.  In choosing a realtor, we considered several options, but ultimately chose to work with Benjamin Clark based on positive recommendations we'd received.  We weren't very familiar with the concept of an Exclusive Buyer's Agent (EBA) at the outset, but during the home buying process learned how valuable it can be to have our realtor looking out solely for our interests.  We never felt pushed into a particular house as we might have with a realtor who also had an interest in selling certain homes.  Our experience with Ben was quite … (2 comments)
