In an opinion delivered by Justice Antonin Scalia, the U.S. Supreme Court found that RESPA only covers consumer fees split by a settlement service provider with at least one other person.The main issue in the case involved the section of RESPA that precludes settlement service providers from collecting fees for services they don’t perform. The court decided that this section only applies when the settlement service provider splits the fee with another provider in the transaction.
